Rep. Mario Diaz-Balart, R-Fla., told reporters Tuesday, "It's a critical situation and if we don't deal with it urgently but well- done right- then we're facing a crisis of just huge proportions."

Diaz-Balart, who along with other lawmakers just visited Central America, described how human smugglers -- known as coyotes - are exploiting perceived changes to U.S. immigration law after the Obama administration decided in 2012 to practice prosecutorial discretion in cases where individuals were brought into the U.S. illegally as minors.

The Obama administration doesn't have much leeway in dealing with unaccompanied child migrants. That's because Congress set a particular process here as a way of fighting human trafficking.

Most of this process was codified by Congress under the Homeland Security Act of 2002; Congress added some additional protections under the Trafficking Victims Protection Reauthorization Act, in 2008.

Under current law, the Border Patrol is required to take child migrants who aren't from Mexico into custody, screen them, and transfer them to the Office of Refugee Resettlement (a part of the Department of Health and Human Services). According HHS, about half the children will qualify for permanent residency under the law. If Homeland Security determines they are not eligible they can be deported. Before they can be deported, a parent or appointed guardian can ask for an immigration hearing which can take many months. When the United States versus 8 year old Jose, you can guess how that't going to turn out.

There two possible solution:
1. Change the law to treat these kids the same as Mexican kids that is; if the border patrol officer making the arrest determines they are not a victim of human trafficking, they are sent back to their home country in 72 hours. This of course will be opposed by human rights organization as well as the boarder patrol. Changing the law will also be embarrassing for US since not only did the US pass these laws to stop human trafficking in the US but was instrumental in passing a UN resolution to stop it abroad.

2. The US can hit these Central American countries with propaganda about the dangers in the trip and problems the kids will face once they are here. It may counteract some the propaganda being spread by coyotes.

Nice post, but you do understand that the impression that these people got was in direct opposition to number 2. The only way they got that impression is from Obama. He is, as he said, on their side.

Yes the Obama administration is hiding behind a law that was passed by a far left Congress and signed by Bush that did not take effect until Obama was well into his 1st term.

This administration is treating all the children like they are all part of some huge human traffic ring..

Time to cut off all aid to the countries that are participating in this..

Update on BCFS: Recall that Baptist Child and Family Services was behind the Federal Government deal for $50M to buy a resort hotel for illegals as The Gateway Pundit reported here and here.

Well, just because the word “Baptist” is in the organization’s title, doesn’t make it a Church. The minimal amount of research brings a person to the BCFS website—home to Health and Human Services (displayed under the BCFS logo in the upper-left corner). Gee, that sounds more like an Obama agency than a Church. Check out the Partners page to find a who’s who list of Federal and State government agencies that are reminiscent of the ACORN complex ties for laundering taxpayer-funded money.
