Heads of The Department of Homeland Security, (DHS) gets sued, suit filed!

ICE agents filed suit against Secretary Janet Napolitano. The suit was filed by a group of agents from Immigration Customs and Enforcement, (ICE) against high level officials. In the complaint it is alleged that Homeland Security Secretary Janet Napolitano and ICE Director John Morton have issued directives forcing agents to break federal laws and violate their oath to protect our country, specifically when it comes to efforts to deport illegal immigrants.

The Agents say that they believe that decisions by top DHS officials are putting them and all Americans at risk. Due to two directives that essentially tell them to let illegal immigrants go unless they are high priority targets like convicted felons.

The suit says agents are being forced, “…to violate federal law… Commands ICE officers to violate their oaths to uphold and support federal law… unconstitutionally usurps and encroaches upon the legislative powers of Congress… and violates the obligation of the executive branch to faithfully execute the law, as required by… the United States Constitution.”

In a statement by Chris Crane the President of the National ICE Council, he said, “We fully anticipate that this administration is going to come down on them like a sledge hammer. I mean these are federal employees they have no protections and we’re ‘very’ concerned that retaliation is going to take place against these folks and they could also lose the ability to support their families just for filing this law suit. So let me tell you, this is not something that we take lightly at all.”

Administration officials say they are acting lawful and within their authority and point to the Supreme Court’s recent ruling on Arizona immigration law, you remember a key portion was upheld but others struck down. In that opinion Justice Anthony Kennedy wrote this:

“Discretion in the enforcement of immigration law embraces immediate human concerns. Unauthorized workers trying to support their… families for example likely possess less danger than alien smugglers or aliens who commit a serious crime.”

So giving the government some room for digression we have asked DHS for comment. They are reviewing the law suit and if we hear back from them we’ll let you know.

"The Obama administration's amnesty program not only rewards lawbreakers, it also forces ICE agents to violate federal law. ICE agents should enforce our immigration laws and apprehend illegal immigrants. But the Obama administration makes it impossible for ICE agents to do their jobs," House Judiciary Committee Chairman Lamar Smith, R-Texas, said in a statement.”

“Sen. Jeff Sessions, R-Ala., has also raised concern about the possibility of ICE agents being compelled to release illegal immigrants with misdemeanor records.”

“"It is a sad day when our nation's law enforcement officers are left with no recourse but to file suit against the administration and its political appointees," he said in a statement.”

Chris Crane is one of the ICE agents leading the lawsuit.

"Right now we are being ordered to follow what we believe to be unlawful orders," said Crane. "As a result we're actually putting the public at risk and our officers at risk. We're actually releasing people that we shouldn't be releasing."

"The order of June 15, where (Janet) Napolitano tries to grant an executive amnesty to dream act aliens breaks federal law," said Kobach. "We are asking the judge to issue an injunction and prohibit the directive of June 15 from being enforced and allow these agents to place illegal aliens in removal proceedings as federal statute commands them to do."

“Deferred Action for Childhood Arrivals”

This program would allow and estimated 1.7 million illegal aliens to stay in the United States legally and obtain jobs legally. The illegal aliens applying for the program will be basically uncheck and trusted on only their word for documentation, on the most behalf. The honor system rarely works with criminals.

Then those illegal aliens who qualify for the program could petition up to 9 relative a piece to come to the U.S. Once the petitioned relatives get their green cards they would be eligible for social service i.e. welfare, public housing, food stamps…

The 1.7 million illegal alien figure would quickly escalate to out of control numbers and would drain our national treasury at a record speed.


“"While potentially millions of illegal immigrants will be permitted to compete with American workers for scarce jobs, there seems to be little if any mechanism in place for vetting fraudulent applications and documentation submitted by illegal immigrants," House Judiciary Committee Chairman Lamar Smith, R-Texas said.”


“Republican lawmakers have accused Obama of circumventing Congress with the new program in an effort to boost his political standing and of favoring illegal immigrants over unemployed U.S. citizens. Some lawmakers have called the policy backdoor amnesty and said they worry about fraud.”
