Please recall that most of the people in NYC are already prejudiced against KSM, so he could receive a technically fair trial and still be found guilty because of the jurors.

To be clear - this is a trial for show. But it is intended to show we will put KSM before a civilian court. This is a political move by Obama which has nothing to do with justice.

It is nonetheless likely that KSM did aid terrorists at some point; there are too many valid targets for the government to waste their show trial on someone whose guilt is in doubt.
