Four football players from Colorado State have been suspended for assault. No big deal that football bullies assault freshmen at a party but the kicker is that they might be charged with hate crimes for using homophobic epithets. Anybody in the real world is aware that the word "faggot" is an insult routinely thrown around but does a punch in the nose automatically get elevated to a hate crime if the word "faggot" is used and the perp is unaware that the victim is actually homosexual? How about if the victim is heterosexual but the perp uses a homophobic epithet? Who gets charged if the victim is homosexual and the perp is Black and the victim uses the "N" word while the perp uses homophobic insults? Do they cancel each other out? The law is confusing ehough without presuming to read minds.
