Well that is the entire reason for the Constitution - to give the federal government the power to take whatever action is necessary to ensure you are not make to feel uncomfortable. So you're right, even if a person is acting completely normal, hasn't hurt anyone else nor has he taken what doesn't belong to him, the feds should through him in jail...because you are uncomfortable. That's a great idea...and certainly Constitutional!

Anything else make you feel icky that we should outlaw? How about someone that's had a drink walking down the street with a knife in his pocket? Toss him in jail? If memory serves, that provision was originally inserted into the gun control act of 1968, and has been there ever since. The language of that provision was probably largely aimed at the violent left, since marijuana was a recreational drug of choice among them at the time. I wouldn't use marijuana if it were completely legal, so I don't really care, but what this illustrates, is how a law intended to harass one's political opponents may someday be turned against you, which is a pretty good reason fro BOTH sides to refrain from enacting such laws to begin with. I have no love for ATF, especially in its recent form, but in this case all it's doing is enforcing a provision of law that's been on the books for years, without much controversy over that provision. If it's a problem, then change it; I'm pretty sure we have a process for that.

This memo has more to do with federal drug policy than with federal firearm policy. Like it or not, in the eyes of the federal government, state-sanctioned medical marijuana use is completely illegal. Enforcement varies (and tends to be higher under Republican administrations). It's not surprising that the ATF is going to tell licensees not to provide guns or ammunition to people who have voluntarily stated that they are violating federal law.

This is old news really. Recently there was a raid on a legal residence, they confiscated his firearms. He was released without charge, but because he had a marijuana permit. They refused to give them back and a Federal judge backed up ATF.

The only "judges" who will hear those cases act like Article I legislative judges whose main functions are to collect their salaries, enjoy federal blue cross / blue shield and aggrandize the federal government!!!!!!!!!!!!!!!!!!!!!

Whether or not it is harmless is not the issue. What you put in your body is none of the federal government's business. It is asinine to think that there is no place in all umpteen million square miles that a dude can go and get high without fear of retribution. I don't care if you want to go lick a cyanide tablet. We have learned recently that the ATF is above the law. Letting guns walk is reason for promotion with Obamas admin.

Federal Drug policy prohibiting recreational/medicial use of Marijuana is unconsitutional period. They needed a Constitutional Amendment to outlaw use of alcohol and they need one to constitutionally outlaw Marijuana use as well. But then again the federal government has been doing many things that are not constitutional for a century, so it is not suprising that the judicial branch hasn't done anything about it.
