Jessie Biag “was and is an innocent man,” his lawyer said in court Monday, calling it a “day of shame” for the justice system after it took more than two years for the Crown to withdraw all charges against him from a random fatal shooting in 2022.
“Today, the correct outcome is being achieved because there are some good people in the justice system who did some good things,” Biag’s lawyer, Jonathan Shime, said in court after the Crown withdrew the remaining firearm-related charges, citing no reasonable prospect of conviction.
“But it is 28 months too late. The justice system did not work for my client. The justice system is not deserving of praise today.”
Biag, now 26, was initially charged by Toronto police with second-degree murder along with James Galinato and Jay-Ar Carbonel in the January 2022 shooting death of 20-year-old journalism student Olivier Dundas following what police described as a random encounter between two groups of friends near Bloor and Church streets. Galinato and Carbonel will still proceed to a jury trial for murder.
