Here in California the problem is Liberal Judges, they let violent criminals go, all the time, to commit more murder.

I don't believe in private or public prisons, though putting criminals in mental health institutions would still be a technical prison - for severely violent/unstable offenders.

With the justice system, you could try rehabilitation centers and close the prisons except for the most severe offenders, but it is simply the case that a lot can't be rehabilated.

You could try the Star Trek utopian justice system, but psychologists /counsellers can't just fix people and send them away easily. If it was that simple, we could just resocialise the lot, put them in jobs and close them down.

Under the hypothetical scenario you get rid of prisons, and capital crimes are branded as instances of insanity or mental instability, it would just be replacing a prison with a technical prison like a high security hospital wing.
