The Ukrainian government should get equally clever to match Vladimir Putin's regime's clever use of agents and Russian security personnel inside Ukraine to prepare for Russia's invasion of Ukraine in clear violation of international law and completely unjust. Any Russian soldier(s) found within Ukraine behind Ukraine's front line should be considered a spy that has caused outstanding harm or has tried to cause outstanding harm to Ukraine's national security and will thus receive capital punishment (this label is legitimate because Russia amassing one-hundred thousand troops on the border justifies the conclusion that a Russian invasion is imminent so spying at this time poses a grave harm to the survival of the sovereign country of Ukraine); if Ukraine military doesn't have a lot of military judges they should make a lot of Ukrainian lawyers, military judges and have them assigned to the front line area. The goal should be to try these captured Russian military personnel behind enemy lines within 48 hours of capture and their execution should be carried out within 24 hours of imposition of sentence; the firing squad execution should not be taped but the press or other independent witnesses should be permitted to witness it so that it is getting back quickly to the Russian Army that there is bad consequences in participating in this unjust military action. This is important once the invasion begins this spy treatment must stop because at that juncture the captured Russian soldiers are morally considered prisoners of war. Ukrainian military should be blanketing these front line areas looking for Russian soldiers conducting sabotage and espionage operations, stopping this Russian strategy will help Ukraine defend against the invasion. Although harder to identify Russian intelligence operative(s) caught behind the front line inside Ukraine where there is clear evidence they are conducting sabotage or espionage operations should likewise be treated as having engaged in extremely dangerous spying and after a trial if found guilty should likewise be executed. This should help counter the playbook the Vladimir Putin regime utilized in conquering Crimea where they had all these little green men wandering around Crimea which weakened its security before the Russian government took over the Crimean Peninsula.

It is important the Ukrainian government be very selective in who they prosecute because it doesn't want to turn significant public opinion against the Ukrainian government. When the Russian military drives through to Kiev they are going to want to install a puppet government loyal to the Putin regime to break the will and morale of the duly elected Ukranian government and its supporters so as to end the war; so the Ukranian government should have its intelligence services monitoring the candidates for the key jobs in the puppet regime and if they can get incriminating evidence prosecute these actors for sedition don't pursue any capital punishment against them just have these enemies of the Ukrainian people put in prison for three to five years, the goal should be to get these bad guys out of the game out of the conflict so they cannot help the Putin regime. Similarly, high profile Ukrainians advocating for secession of parts or the entirety of Ukraine to Russia and similar bad advocacy should be tried for sedition and sent to prison for three to five years again get them out of the conflict so they cannot hurt the Ukrainian government. This threat from the Putin regime is either going to succeed or be withdrawn in a three to five year time frame because if it gets drawn out into this long bloody conflict Russian mothers are not going to want to see a long period of their sons dying in high numbers in Russian military service and if this is occurring they will put public pressure on the Russian government to stop the war which means the Putin regime would have to withdrawal from Ukraine and so the War will be over!
Currently, the Ukrainian government is probably experiencing a lot of serious sabotage and espionage in Ukraine, their country has a history of puppet regimes orchestrated by Russia so Ukraine probably has a significant number of Russian sympathizers amongst its population where some are so biased for Russia they are probably doing acts of treason. The Ukrainian government should shoot adrenaline into its law enforcement and intelligence services to be on the look out for significant actors in the area of sabotage and espionage because once the Russian invasion begins these bad guys could cause the death of a lot of good Ukrainian soldiers so it really behooves the Ukrainian government to step up prosecutions here. I think only in a very careful and restricted manner should the Ukrainian government go for capital punishment in these cases only because you don't want to execute innocent people and good societies really try extremely hard not to give capital punishment unless there is no doubt the criminal did the capital crime. Confession evidence and eyewitness evidence is not sufficient to issue a capital sentence because such evidence is not beyond error; however, if evidence exists of videotapes or audiotapes or if the defendant is caught in possession of compelling evidence of the crime or is caught in the act of carrying out the criminal behavior that is sufficient. The extremely salient point here is that it would be very helpful for Ukraine's security and if it can be done justly to create a deterrent for the population of Ukraine that communicates that one doesn't want to engage in treason, sabotage or espionage to help Russia against the Ukrainian government because if one is caught one will end up forfeiting his or her life over it!
