Dearies actions are not tied up in court anymore as the 11th Circuit ruled that the DOJ:
  • does not have to turn classified documents over to the defense, and
  • that the DOJ can continue to use the classified documents as part of their criminal investigation.
So while Judge Dearie put the FPOTUS legal team in a bind saying (to paraphrase) put-up or shut-up, the classified documents are no longer even part of the Special Master review. Then they whined to Judge Cannon saying (to paraphrase) "their being mean and we don't wanna". With the 11th ruling on the question of classified documents, as they are clearly classified government property, they are now outside the scope of his purpose.

It was a major loss for the FPOTUS as he (a) wanted them INCLUDED in the Special Master review as part of a delaying process for court proceedings, and (b) the DOJ was allowed to proceed with the criminal investigation surrounding the mishandling and the refusal to return the classified documents.

Yes they did, but it has nothing to do with the comments we were exchanging about classified documents. The 11th had already ruled that the DOJ could use the classified documents in their continuing criminal investigation.

Actually, to put it correctly...

If the DOJ wins then the unclassified document review becomes moot. Classified documents are already moot, as they pertain to the Special Master.

The 11th Circuit ruled that they were government documents, that the FPOTUS had no ownership claim to them so they need not be returned, that the FPOTUS had no privilege claim to them, and that the DOJ/FBI could continue to use them. The FPOTUS challenged part of the 11th Circuits ruling to the SCOTUS and the SCOTUS rejected it. Therefore the Special Master has no more duties pertaining to classified documents. From his perspective the issue is moot.

If you're not interested in the answer to those questions, you don't care whether the story is true or false.

It's easy to leak smears, but not so easy to bring evidence to a court. That's why there has been no indictment of Trump after seven years of leaked smears.
