Well...having read the article...I was wrong about his/her possession of a penis--I've never heard of an inmate being transferred to a woman's prison prior to surgery. It appears that the inmate in question stopped taking their hormone pills.
Here is the original article..with considerable more info then the Op's--that being said, it also appears that a number of false allegations have been made..and that the inmate is in segregation. As the inmate is a preoperative transgender who is not on their pills...I would house as male. The female inmates were hostile to the transfer..and appear to have engaged in a constant series of attacks and false allegations--which is not to say that there might not be some truth in there as well.

Every crime is alleged until conviction. Sad to say this black rapist still had a fully functioning penis. The article said that he was transferred because he "wished for reassignment surgery". Or at least he SAID he had wishes.

This has happened before. Once to an abuser of women. He said he now identified as a woman and got transferred to a woman's prison where he was in a candy store of victims. Imagine Ted Bundy making a claim that he identified as a woman and wanted to be housed among women. It is discriminatory to demand sex change surgery before housing among women.
