"No-One Ever Died Illegally in Auschwitz": The Nazis' Obsession with Legalizing the Holocaust

Published on Nov 28, 2012
Harry Reicher, Professor of Law & Scholar-in-Residence at the Institute for Holocaust Law and International Human Rights at Touro Law delivered a Kristallnacht lecture to the Touro Law community on November 15, 2012 titled, "No-One Ever Died Illegally in Auschwitz": The Nazis' Obsession with Legalizing the Holocaust. This presentation examined the perversion of the country's legislative system, and its conversion into a savage instrument, designed to discriminate against, ostracize, dehumanize, and ultimately eliminate, its victims. It is a little-known dimension to the Holocaust, which added another weapon to the armory employed by the Nazis.

.There are a couple of ways a country can get away with legalizing injustice. The first way is to take over the information sources and create a propaganda arm of government and the second way is to force (or encourage) judicial part of the government to cooperate with the administration. Hitler's atrocities are the ultimate extreme example of how insane a country can become but they were made possible because the Nazi's had taken over the media and had thrown out whatever constitutional government was in place. The Germans gave away their country and allowed Hitler to assume a dictatorship and Nazi atrocities were either justified by the minister of propaganda or ignored. After WW2 started, the first thing the FDR administration did was issue an order or a series of orders that authorized the government to restrict the 1st Amendment's freedom of the press/speech for the duration. Minor criticism of the government would be met with a visit from law enforcement and possibly viewed as treason. When FDR issued an illegal executive order that authorized the rounding up of American citizens and the confiscation of their property without due process and ordered their incarceration for the duration of the war there was no outrage because the sources of information available to Americans became a propaganda arm of the government. FDR sealed the deal by making sure the judicial branch would cooperate. A former KKK member whom FDR appointed to the Supreme Court, Justice Black wrote the majority opinion that justified the arrest of American citizens without due process. The fix was in and even after FDR was gone the mainstream media remained a propaganda arm of the democrat party well up into the "information age" and instead of being correctly viewed as criminal, the FDR legacy was rewritten in heroic terms. In 1948 the same bigoted former KKK Supreme Court Justice wrote the majority opinion that created the "separation of church and state" that had no basis in Constitutional law.

IMHO, we have that happening here already in some cases. A friend shared what happen to them when a larger firm stole a few million dollars worth of equipment. They tried to lay the blame on this person and went after them with a vengeance. When FBI learned they had screwed up they made it worse and doubled down on these people and their family. So a crooked contracting firm, a mad insurance company and investor firm caused a couple that just had a new born a few weeks earlier to go through hell. The truth eventually came out but it still crushed the family about who was crooking who and it was not the worker.

When the people in charge of justice pull this kind of crap they attempt to bury the victims.
