Suit against God thrown out over lack of address

LINCOLN, Neb. (AP) - A judge has thrown out a Nebraska legislator's lawsuit against God, saying the Almighty wasn't properly served due to his unlisted home address.

State Sen. Ernie Chambers filed the lawsuit last year seeking a permanent injunction against God. He said God has made terroristic threats against the senator and his constituents in Omaha, inspired fear and caused "widespread death, destruction and terrorization of millions upon millions of the Earth's inhabitants."

Chambers has said he filed the lawsuit to make the point that everyone should have access to the courts regardless of whether they are rich or poor.

On Tuesday, however, Douglas County District Court Judge Marlon Polk ruled that under state law a plaintiff must have access to the defendant for a lawsuit to move forward.

"Given that this court finds that there can never be service effectuated on the named defendant this action will be dismissed with prejudice," Polk wrote.

Chambers, who graduated from law school but never took the bar exam, thinks he's found a hole in the judge's ruling.

"The court itself acknowledges the existence of God," Chambers said Wednesday. "A consequence of that acknowledgment is a recognition of God's omniscience."

Therefore, Chambers said, "Since God knows everything, God has notice of this lawsuit."

Chambers has 30 days to decide whether to appeal. He said he hasn't decided yet.

Chambers, who has served a record 38 years in the Nebraska Legislature, is not returning next year because of term limits. He skips morning prayers during the legislative session and often criticizes Christians.

He was really funny in that film, but for me I suppose the context was important. I saw it at a private theatrical screening put on by my ex's law firm for partners, staff, families and major clients - it carried a certain piquancy :lol:

That sounds like an interesting way to see a movie like that. ;o)

we saw him do his stand up act at The Bottom Line years ago. He was briliant.

I thought the judge's decision was very creative, though.
 
When I worked for our union one of the industrial advocates was a huge Billy fan and used to imitate him in the office. I threatened to sack him because the female staff were complaining about his effing and blinding. He was apparently a bit too good an impersonator. Funny though, he became a lawyer as well.......:eusa_whistle: :lol:

The judge in this one was not only smart but witty. Every now and again you get one like that and they can put a bit of a smile on your face.

Chamber's is right, God is all knowing! So wouldn't he have known if he was being sued? Does that mean he has a warrant for his arrest because he didn't show up for court?lol
If one wanted to see damages, who would pay? The catholic church is already bankrupt, so therefore would it be the mormon church they seem to have the most money?

I recall one decision a judge actually wrote in poetry form. Let's you know that occassionally some people take pride in their work!

The law REQUIRES a subpeona be delivered. Since one was not no case, does not matter one bit what some one knows or not.

I think I remember that one.

I wonder if it would inspire counsel to, next time, if an ex tempore decision is handed down to ask the judge, "excuse me your honour, is that in iambic pentameter or just blank verse?"

I reckon one chance :lol:
 
There are other problems as well. God does not live, reside or exist in any form in any country on earth, Thus no Jurisdiction exists for man to sue him or bring him before a court of law.

God does not answer to man's Government either.
