42 USC § 18115 - Freedom not to participate in Federal health insurance programs

No individual, company, business, nonprofit entity, or health insurance issuer offering group or individual health insurance coverage shall be required to participate in any Federal health insurance program created under this Act (or any amendments made by this Act), or in any Federal health insurance program expanded by this Act (or any such amendments), and there shall be no penalty or fine imposed upon any such issuer for choosing not to participate in such programs.
 
Looks it does leave insurance companies the option of continuing to sell homeowner policies, auto policies, flood policies and earthquake policies without having to sell any health insurance that might have in the past.

I don't know of any that might have so decided but at least that door remains open for those who want to participate in gang rape.

Insurance companies have never been required to carry or provide Federal Healthcare Programs ... Although the programs they do offer must meet minimum Federal requirements.
No one has ever had to participate in Federal Healthcare Programs ... You can still buy Insurance from any number of Private agencies.
The fine is not levied if you don't go for the Federal Healthcare Program ... It applies to people who don't have any insurance Federal or Private.
So in a sense it means nothing ... Because the fine is not specific to Federal Healthcare Programs and the Insurance companies can choose to offer their own healthcare programs as long as they meet minimum standards.

What it means is that the government cannot force insurers to offer the specific ACA healthcare plans ... And cannot fine or penalize people or insurance companies if they choose not to select or offer specific ACA healthcare plans.

I guess insurance companies could just opt out of obamacare exchanges and do what they want.

Some states (13) have already opted out of the exchanges and insurance is handle individually at the state level.
Insurance is still sold in those states ... The minimum Federal requirements for insurance are still applicable ... The Individual Mandate still applies towards having some insurance coverage.
