The two articles posted about the accident in this thread contain these puzzling details (I initially hoped it was due to ignorant article writers rushing to get out the story, but this doesn’t seem to be the case).

First puzzling fact: Indiana’s law- anyone testing over .08 BAC is considered to be intoxicated and this driver tested at .13 percent but was reportedly not arrested at the scene because it was determined that there was no proof that he was the cause of the accident. Reportedly, the pedestrians’ actions determined to be the main cause of the accident because they were in the street (there were no sidewalks). Hold up, so the driver’s car ended up running into a house after striking the 2 females and a male, yet he was not arrested at the scene? Something’s not adding up here and I’m only on the first puzzling factor.

2. The driver was driving over 40 mph on a 30 mph road.

3. The driver was given a 60 day suspension for his drivers license when the usual time is 180 days in Indiana for first time offenders.

4. There was a second driver of another vehicle who drove over one of the two female victims when the victim was lying in the road. The second driver stated she could not see the girl lying in the road until moments before she drove over her. Apparently, this was a dark road in need of adequate street lights as no mention of bad weather/ poor visibility being a factor. I’m only mentioning this because this is what that neighborhood will be doing to improve that area on that street if lack of street lights was a factor, and maybe add a posted speed limit sign.

A horrible tragedy for so many lives. Skin color should be the last thing on any judge’s mind when sentencing anyone and when considering legal determinations. Not sure that was the case here, but I don’t claim to know.

I’m still stuck on the part that they tested a driver who was over the limit of .08 percent with BAC testing at .13 percent yet didn’t arrest him at the scene because they reportedly stated there was no evidence that he was the factor of the accident. What the….. sure, it must’ve been that second car that ran over one of the girl’s after she’d already been hit and lying in the road. According to the articles, that particular girl’s family is not making a civil suit against the driver while the other girl’s family is ….along with a second civil suit filed by the owner of the house that was hit.

Recap- 2 dead, female pedestrians on the road along with one injured male, a car found crashed into a house, driver awaiting police, tested over legal limit for BAC at .13 percent, but not arrested at the scene because of lack of evidence. Got it.

To know whether that young man received undue leniency, one would probably have to know the laws of that state and to know the situation of ethnic relations in that state.

To base one's decision solely on a newspaper article is probably unfair.
 
It is interesting. The accounts don’t describe the accident. But Hawk assumes that the Black Driver was racing around drunk and high.

From what I gathered it sounded like two drunk girls stumbled right in front of a drunk driver. He swerved too late to miss them and ended up hitting a house.

Hawk would have us execute the Black Guy because he’s Black.

Now, I’m not sure, but it sounds to me like the girls, who were also described as drunk, stumbled or danced or whatever into the road. If so, then they caused the accident didn’t they? If they appeared right in front of the driver without sufficient time to react even if he had been sober?

The driver was drunk. His BAC was .13 and he wasn't even arrested.

That's disgusting...
 
Yes the driver was drunk and driving at excessive speed on a residential road but the girls were in the middle of the road.
In the eyes of the law the girls were primarily at fault for putting themselves into traffic.
The DUI kid got the maximum amount of time and punishment allowed by their laws for his crime...
It wasn't leniency by the judge by any means but a lack of laws allowing the judge to sentence the drunk kid sufficiently. (Minimum and maximum sentencing guidelines are mandates)

There's no leniency or favoritism here...
