Since he was charged with the EXACT same crime as the first one they had no choice. As soon as the first one showed up to testify he was NOT GUILTY, the whole thing would have collapsed.

Now hopefully at the third trial these two will show up and testify the man never hit the terrorist, destroying that case as well.
