So medium sized groves that are harvested by illegals and irrigated with their sewer water shouldn't be inspected for safety in the same manner as larger growers?
Anyone selling produce for public consumption should be subjected to stricy inspection standards.
Being in the restaurant industry for almost 30 years it would be really nice if, when I ran out of lettuce, I could run across the street to a produce stand and buy some from them rather than having to order from "an approved food source" at a much higher price.
How comfortable are you going to a restaurant and not being sure of the quality of produce they're using??
How can you be sure that proper temperatures are kept or proper rotation. What chemicals are on it? etc....

After a year-long battle with small farms, big farms, food establishments and government, a law that is meant to make our food supply safer was finally passed.

That little amendment that could (and did make this possible): A last-minute provision to the bill, which ruled exempt farmers selling less than $500,000 each year (in other words, small farmers) that “directly market to consumers in a 275 mile areas."

What does the act do? CBS has a pretty good list, below:

- Gives the FDA authority to recall contaminated foods. It is currently a voluntary system
- Increases inspections at food facilities. Once every three years for high-risk facilities.
- Requires importers to verify food safety.
- Increases traceability and tracking of high risk foods. Creates a pilot program to increase contamination traceability.
- Allows FDA to access records if there is reasonable probability a food is causing sickness or death in humans or animals.
- Allows FDA to create new standards for the safety of fresh produce.
- FDA can collect fees for non-compliance with recalls or reinspections.
- FDA must form new regulations on safe food transport conditions.
- FDA can allow outside laboratories to conduct third party inspections to ease the load for the FDA.
- Increases funding and staff at FDA.

Under the rubric of safety, this Senate proposes a bill that establishes such new and sweeping powers over how you and I produce and consume foodstuffs that even the Pew Charitable Trusts * are calling S510 a clear and present danger. National Health Freedom says,


It is a dangerously broad regulatory bill giving extensive discretionary power to the FDA over the entire food supply chain without proper checks and balances to avoid abuse of power;


It would impose one-size-fits-all-regulations on thousands of small and mid-sized farmers, small-scale local farms and food producers, and would drastically burden, to extinction, basic natural and organic food suppliers, thus endangering the lives of Americans who depend on local wholesome foods;


It does not reflect a well-thought-out solution, or address the real causes of food safety issues stemming from the industrialized food supply chain; and


It attempts to limit the authority of our own domestic U.S. laws when it includes language ensuring that our US law will not disturb other international agreements that we have made. It states: "Nothing in this Act shall be construed in a manner inconsistent with the agreement establishing the World Trade Organization or any other treaty or international agreement to which the U.S. is a party."


Lee Bechtel of the National Health Federation, the nation's oldest health-freedom organization, says,


The concern for freedom and health freedom advocates with the legislation, and the NHF's concern, is not because it addresses existing conventional food safety system problems, tainted imported foods, peanut butter... et.al. but because of these non-conventional food safety attempts to expand FDA authority and impose more controls over the marketplace and the access to nutritional foods and supplements.

The one thing I noticed in the Bill is the Benchmark is way too low at $500.000.00. Thats nothing in relation to what's involved with growing. how about 5 Million, or 15 million, for starters. I'm sure there are many reasonable controls in the Bill, the question is where is the line to be drawn, in fairness. What is realistic expectation, and what is by design, a function to oppress and shut down small Agriculture? What in the Bill is hurtful by design? Why is it there?
