He doesn't actually have to be a member of Congress to be Speaker of the House.

That said, it's almost certain they'll choose McCarthy for Speaker, and there's zero chance Biden and Harris will be impeached AND convicted. I doubt the feckless Republicans under McCarthy will even open any ethics probes into obvious malfeasance by members of Congress, nonetheless pursue articles of impeachment against the president.
