UPDATE: Details of Deadly Cabell Shootings Released in Court Documents

Cabell County Sheriff Tom McComas says Garrick Hopkins, 60, of Milton and his brother, Carl Hopkins Jr., 61, of Oak Hill, W.Va. died after being shot by Black.

The shooting happened outside Black’s home at 12 Lane Drive about 2:30 p.m Saturday.

According to the criminal complaint, Black told detectives in his statement that he saw two men “shaking the door on his tool shed in his backyard.” He said he then “reached and got his .243 and loaded the gun and pointed the gun out of his window and the shot the first male and then pulled the bolt action back and fired another shot and hit the other male.”

Black also told deputies in his statement that the “did not warn them nor did he call 911 when saw them.”

He also advised that “no first aid was given after the incident.”

Sheriff McComas said in a release on Sunday that Garrick Hopkins had recently purchased the lot adjacent to #12 Lane Drive.

McComas says he took his brother to the property Saturday to show him where he and his family were planning to build their new home in the coming weeks.

The Sheriff says the outbuilding in question was on the Hopkins property and contained no belonging of Mr. Black’s.

Inside Black's home, McComas says detectives seized a large number of weapons and ammunition.

If you're gonna talk about something at least have a clue about the law. You can't fire warning shots there. And even if they were they weren't in the actual house so the man was in no situation where he was in imminent danger and forced to retreat. So the Castle Doctrine does not apply. I know it doesn't matter. You just want everyone's guns regardless. But it still should be clarified.

Im what you might call a right winger. Im appalled by this story and he should go to prison. That doesn't mean I want to ban guns though, if that's what your getting at.

This was not a stand your ground case, nor do we have a responsible gun owner here.

The thread title is a lie. This man is being charged with two counts of 1st degree murder, and rightly so.

As an advocate for the second amendment, I would like to say that there was no reason in hell for these men to be shot and killed. Mr. Black needs to go down for this one - good case for the death penalty.

Not all persons should own firearms.
 
It would seem that NTG needs a dictionary, she (He? Dunno...) obviously has no clue as to the definition of the word "responsible..."

The story is about a man who acted criminally, maliciously, and with intent to kill.

Death penalty should be the result if justice is to be satisfied.

There is no 2d Amendment issue here at all.
