Obama had no Constitutional authority to "fill a seat." He had a Constitutional power to nominate someone, he did.

The Senate had the power of advice and consent. They said no.

The Senate confirmed Cory Wilson, a state court judge in Mississippi, to serve on the Fifth Circuit Court of Appeals in a 52-48 vote.

So I must ask why aren't any judges appointed this year not as important as this one judicial seat?
