The questions are how has it been enforced and have there been amendments to the Act?

My guess - and its just a guess - is that oil companies weren't being prosecuted under the Act for a handful of birds dying in refuse pits 80 years ago. But I might be wrong, I don't know.
According to this link, going after oil companies for bird deaths started occuring in the 1970s.

I don't think anyone has asked this yet, but, uhm, what's the big deal here? If the companies are negligent under the law, then they need to pay a fine. In this case, the fine mentioned was $15,000.

Are you all saying a $15K fine will break an oil company? Or are you saying that oil companies should be allowed to break the law?

These regs have been on the books for decades, in one form or another. Why now, why North Dakota?
There's an employment boom going on there, real industrial activity, real jobs, real contributions to GDP and the production of a commodity that reduces imports and puts hard currency into the pockets of the working pubilc as well as local state and federal coffers.

But no, fuck all that- on the drawing board is nearly $100 billion in tax penalties for the industy.

I would be very surprised if there wasn't more to the story. This isn't a news article, it's an editorial based on the (verified?) statements of one of the actors in the story. This means that the author didn't have any need to call the Justice Department for comment.

I suspect there is quite a bit more to the story. Bird kills due to a business's lack of precautions usually results in a slap on hand for a first offense. The is reported to be a criminal prosecution which is reserved for repeated offenses or where the business opening refuses to obey the law.

If you don't like the law, pressure government to change the law. Ignoring the law is not an acceptable solution.
