This disclosure, revealed in documents obtained by Fox News, could undermine the Department of Justice's previous defense that Operation Fast and Furious was a "botched" operation where agents simply "lost track" of weapons as they were transferred from one illegal buyer to another. Instead, it heightens the culpability of the federal government as Mexico, according to sources, has opened two criminal investigations into the operation that flooded their country with illegal weapons

Operation Fast and Furious began in October 2009. In it, federal agents from the Bureau of Alcohol, Tobacco, Firearms and Explosives encouraged gun stores to sell weapons to an arms smuggling gang, then watched as the guns crossed the border and were used in crimes. Each month, the agency allowed hundreds of guns to go South, despite opposition from some agents.

All told, the gang spent more than $1.25 million for the illegal guns.

In June 2010, however, the ATF dramatically upped the ante, making the U.S. government the actual "seller" of guns.

According to documents obtained by Fox News, Agent John Dodson was ordered to buy six semi-automatic Draco pistols -- two of those were purchased at the Lone Wolf gun store in Peoria, Ariz. An unusual sale, Dodson was sent to the store with a letter of approval from David Voth, an ATF group supervisor.

Dodson then sold the weapons to known illegal buyers, while fellow agents watched from their cars nearby."

ATF Fast and Furious guns turned up in El Paso
September 29, 2011 Washington — They were being stored for shipment to Mexico, documents show. It's the first case of vanished weapons from the surveillance program showing up on this side of the border outside the Phoenix area.
A cache of assault weapons lost in the ATF's gun-trafficking surveillance operation in Phoenix turned up in El Paso, where it was being stored for shipment to Mexico, according to new internal agency emails and federal court records. Forty firearms along with ammunition magazines and ballistic vests were discovered in Texas in January 2010 during the early stages of the program, meaning the firearms vanished soon after the program began. Under the program, dubbed Fast and Furious, agents with the federal Bureau of Alcohol, Tobacco, Firearms and Explosives in the Phoenix field office allowed licensed firearm dealers to sell weapons to illegal "straw" buyers in the hope that the agents could track the weapons and arrest Mexican drug cartel leaders.

Instead, more than 2,000 weapons were trafficked along the U.S.-Mexico border, and many were used in violent crimes in Mexico. In addition, two AK-47 semi-automatics involved in the program were recovered after a U.S. Border Patrol agent was killed south of Tucson, and two others were found after a violent confrontation with state police officers in Maricopa, Ariz. The El Paso case is the first example of Fast and Furious weapons turning up on this side of the border outside the Phoenix area. According to an ATF document, Sean Christopher Steward bought the 40 AK-47-type assault rifles on Dec. 24, 2009, from the Lone Wolf Trading Co. gun store in Glendale, a suburb of Phoenix. The cache was part of 290 firearms ultimately acquired by Steward, a convicted drug felon, during the Fast and Furious operation.

Last January, he and 19 others were indicted in the only criminal case to arise out of Fast and Furious. According to ATF emails and a federal court affidavit, El Paso police officers tracking alleged drug smuggling from Mexico followed a dark blue Volkswagen Jetta as it backed into a garage at a residence on Jan. 13, 2010. The driver was identified as Alberto Sandoval. Police later searched the vehicle and found the weapons and other devices.

According to an email from ATF Special Agent Oscar B. Flores in El Paso, Sandoval told authorities that he was paid $1,000 "to store the firearms at his residence until they could be transported to the Republic of Mexico" by an unknown third party. More emails discussing Sandoval's arrest and the recovery of the weapons were sent to Washington headquarters and Kenneth Melson, then the ATF acting director, and William J. Hoover, the assistant director. Sandoval was indicted and pleaded guilty to weapons charges in May 2010 in U.S. District Court in El Paso. He was sentenced to 61/2 years in prison.

Emails show top Justice Department officials knew of ATF gun program
October 3, 2011, Washington — Memos from 2010 show some in senior positions were aware of tactics used in a surveillance operation in which firearms were allowed into Mexico in a failed effort to catch drug cartel leaders.
Senior Justice Department officials were aware that ATF agents allowed firearms to be "walked" into Mexico, according to a series of emails last year in which they discussed two undercover operations on the Southwest border, including the failed Fast and Furious program. In the emails that the department turned over to congressional investigators, Justice Department officials last October discussed both the Fast and Furious gun-trafficking surveillance operation in Phoenix and a separate investigation from 2006 and 2007 called Operation Wide Receiver. In Wide Receiver, which took place in Tucson, firearms also were acquired by illegal straw purchasers and lost in Mexico, the emails say.

The term "gun walking" is central to the failure of Fast and Furious. Agents with the federal Bureau of Alcohol, Tobacco, Firearms and Explosives purposely allowed licensed firearms dealers to sell weapons to illegal straw buyers, hoping to track the guns to Mexican drug cartel leaders and arrest them. But they lost track of more than 2,000 weapons, and the Mexican government says some of them have turned up at about 170 crime scenes there. Two were recovered at the scene of a U.S. Border Patrol agent's slaying in Arizona in December.

Justice Department officials have said repeatedly that they knew nothing of Fast and Furious tactics until ATF whistle-blowers went public this year with allegations that guns were being illegally purchased with the ATF's knowledge. Justice Department officials, who asked not to be identified because of the ongoing investigations into Fast and Furious, said that although senior department officials knew that guns were "walked" in the Wide Receiver investigation, they were unaware that ATF agents were using similar tactics in Fast and Furious.

Jason Weinstein, deputy attorney general in the criminal division, brought up both cases in an October 2010 email, apparently concerned that they were going to overlap. "Do you think we should try to have Lanny participate in press when Fast and Furious and [the] Tucson case are unsealed?" he asked about his boss, Lanny A. Breuer, head of the criminal division. "It's a tricky case given the number of guns that have walked but it is a significant set of prosecutions." James Trusty, acting chief of the department's organized crime and gang section, responded, "I think so but the timing is tricky too."

Documents detailing discussions between a Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) agent and a White House National Security staffer concerning Operation Fast and Furious have been made public by the Obama administration, but reveal no new information about what top White House officials knew about the controversial investigation. Released late Friday night, the documents include emails over a month-long period last year between William D. Newell, then-ATF special agent in charge of the Phoenix field division, and then-White House National Security staffer Kevin O'Reilly. In them, they discuss the progress of gun trafficking investigations along the U.S.-Mexico border and Mr. O'Reilly displays a keen interest in the topic.

While the emails outline an apparent close friendship between Mr. Newell and Mr. O'Reilly, they do not include any specific mentions or discussion of how the Fast and Furious program was handled, who directed it or what officials, if any, inside the Justice Department or White House knew about it. The words “fast and furious” do not appear in any of the emails, many of which are duplicates. White House Counsel Kathryn Ruemmler said in releasing the documents that internal National Security staff emails were not included because the Executive Office of the President “has significant confidentiality interests in its internal communications.” The letter was obtained Friday by Politico.

The undercover Fast and Furious probe monitored the purchase by straw buyers of hundreds of weapons at gun shops in Phoenix. Many of the guns, including AK-47 assault weapons and Barrett .50-caliber sniper rifles, eventually were transferred to others in Arizona and then later “walked” to drug cartel members in Mexico. At least two AK-47 assault rifles purchased as a part of the probe turned up at the site of the fatal shooting of U.S. Border Patrol Agent Brian A. Terry, killed by Mexican bandits just north of Nogales, Ariz.

President Obama has said he did not authorize the program and Attorney General Eric H. Holder Jr., who has also pleaded ignorance, has called for an investigation by the Justice Department’s Office of Inspector General. Sen. Charles E. Grassley of Iowa, ranking Republican on the Senate Judiciary Committee, and Rep. Darrell Issa, California Republican and chairman of the House Oversight and Government Reform Committee, have been investigating the Fast and Furious operation for several months and have been stymied in their request for documents in the probe.

Memo: Holder told of ‘Fast and Furious’ as early as July 2010
Tuesday, October 4, 2011 - Newly obtained Justice Department memos show that Attorney General Eric H. Holder Jr. was told about the controversial “Fast and Furious” weapons investigation as early as July 2010, apparently contradicting testimony he gave before a House committee in May saying he learned of the operation just weeks earlier.
A July 10, 2010, memo to Mr. Holder from Michael Walther, director of the National Drug Intelligence Center (NDIC), specifically identifies the Bureau of Alcohol, Tobacco, Firearms and Explosives-led Fast and Furious operation, says when it began, names the federal law enforcement agencies involved, and identifies the major investigative targets. The memo, sent to Mr. Holder through the office of the acting deputy attorney general, also notes that the operation involved a Phoenix-based firearms-trafficking ring and says “straw purchasers” were responsible for buying 1,500 firearms “that were then supplied to Mexican drug-trafficking cartels.” The Walther memo also says the straw buyers had direct ties to the Sinaloa drug cartel, “which is suspected of providing $1 million for the purchase of firearms in the greater Phoenix area.” A straw buyer is someone who purchases a weapon for someone who is unable to buy it himself.

The memo, first reported by CBS News, prompted calls Tuesday from Capitol Hill Republicans for a special prosecutor and led the White House to claim Mr. Holder misunderstood the questions, rather than lied, during the May congressional testimony. On May 3, Mr. Holder told the House Judiciary Committee he only recently had become aware of the Fast and Furious operation, and never made mention of the 10-month-old Walther memo. His comment came in response to a question from Rep. Darrell E. Issa, California Republican, who has been investigating the operation for several months and had asked the Justice Department on several occasions without success for more information. “I’m not sure of the exact date, but I probably heard about Fast and Furious for the first time over the last few weeks,” Mr. Holder testified.

On Tuesday, Rep. Lamar Smith, Texas Republican and chairman of the House Judiciary Committee, called on President Obama to instruct the Justice Department to appoint a special counsel to determine whether members of Congress were misled by Mr. Holder during his testimony on what he knew about Fast and Furious. Mr. Smith said that in response to the committee’s ongoing investigation, the department recently provided documents that “raise significant questions about the truthfulness of the attorney general’s testimony.” “The department’s consistent response to Congress has been that Operation Fast and Furious was a discrete law enforcement effort largely isolated to the ATF office in Phoenix,” he said in the letter. “These documents appear to undermine this claim and bring into question statements made by Attorney General Holder to this committee.

“Allegations that senior Justice Department officials may have intentionally misled members of Congress are extremely troubling and must be addressed by an independent and objective special counsel,” he said. Rep. Ted Poe, Texas Republican and a former prosecutor and judge, said an independent prosecutor should be named to find out if government officials broke the law in the operation. During an interview on a National Rifle Association radio show, he described the operation as a “failed, idiotic idea,” during which at least one weapon was used to kill a U.S. law enforcement official. “The more we learn, the worse it gets,” he said.

Carney replied, “As he [Obama] said in public at a press conference, he heard when he read about it sometime earlier this year. The press conference was in El Salvador when he was on that trip. I don’t have a specific day.”

Carney told CNSNews.com after the briefing that Obama did not speak about it at the press conference, which was held on March 22 in El Salvador. The White House press office clarified that Obama spoke about the matter on CNN Espanol. Carney said he did not have an exact date or month when the president first read about it in the news. On March 22, Obama also gave an interview to the Spanish-language Univision and was asked about Operation Fast and Furious. The president did not specify when he found out about the botched gun-running operation, only that he was not informed.

“Well, first of all, I did not authorize it,” Obama said on Univision. “Eric Holder, the attorney general, did not authorize it. He’s been very clear that our policy is to catch gun-runners and put them in jail. So, what he’s done is, he’s assigned an IG, an inspector general to investigate what exactly happened here. The reporter then asked, “So who authorized it?” Obama said, “Well, we don’t have all the facts. That’s why the IG is in business.” “And you were not even informed about it?” said the reporter. Obama said, “Absolutely not. This is a pretty big government, the United States government. I’ve got a lot of moving parts.”

“There may be a situation here in which a serious mistake was made,” said Obama. “If that’s the case, then we’ll find -- find out and we’ll hold somebody accountable.” The Univision reporter then asked, “Mexico was not informed then?” Obama answered, “Well, if I wasn’t informed, I assure you Mexico wasn’t.” Operation Fast and Furious was a botched gun-sting operation in which the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) knowingly allowed guns to flow to Mexican drug cartels. The ATF lost track of most of the near 2,000 guns that it intended to track. The program that began in September 2009 was halted in December 2010 when two guns from the operation were found at the murder scene of Border Patrol agent Brian Terry. The matter is under investigation by Congress and the Justice Department’s Office of Inspector General.

(Oops!! CBS bad! Very bad! A certain CBS reporter drifted into the domain of one Laura Ingraham, evil Conservative talk show host, and revealed that the WhiteHouse was screaming at her for her revealing that Eric Holder, the Attorney General of the United States, had gone to Congress and lied to them. Now CBS, the organization the reporter works for, has dutifully circled the wagons regarding this reporter, probably after the WhiteHouse approached someone more senior at CBS than the reporter, and informed them in no uncertain terms that CBS News responsibility was protecting this president first, reporting the news second, especially in the case of this Democratic administration.)

Today, I called CBS News in an attempt to interview Attkisson. I was told by CBS News senior vice president of communications Sonya McNair that Attkisson would be unavailable for interviews all week. When I asked why Attkisson would be unavailable, McNair would not say.

I’ve also heard from a producer at another media outlet that has previously booked Attkisson that they tried to book her since she made news with the Laura Ingraham interview yesterday. They were also told that she would be unavailable.

After our initial conversation earlier today, I called McNair back and left a message with her office. I also sent McNair an email asking whether Attkisson’s unavailability has anything to do with reporting that the White House and Justice Department were angry at her. I further asked McNair if the White House or Justice Department contacted CBS News about Attkisson since yesterday. McNair has not responded to my inquiries

CBS News, not as egregious today as they were in former years, along with their star reporter, Walter Cronkite, supplying their good offices and helicopter transport to ferry anti VietNam war speaker Edmund Muskie from one speaking engagement to another at a time when their nation was at war, a veritable act of treason, at a time when CBS News controlled all the microphones and loudspeakers, so who was to know besides the FBI?

Be careful what you wish for, House Republicans, over the metastasizing Operation "Fast and Furious" scandal at the U.S. Department of Justice. You just might get it.

A Special Prosecutor, I mean. That's exactly what, as we move into the 2012 election year, the GOP shouldn't want.

From a GOP political perspective, Operation "Fast and Furious" is the kind of thing you pray to Jesus for. A year before a national election, the story breaks that some numb nuts at Main DOJ -- the agency formerly known as ATF, to be specific -- conceived a novel idea for catching Mexican cartels (and their U.S. firearms suppliers) in illegal gun smuggling. Here's how: let's have the U.S. Government give the gun dealers guns so they can be smuggled.

Lots of guns -- at least count, at least 2,000 of them.

It worked too. Oh, my, how it worked.

The US government-supplied weapons were duly purchased by the bad guys. They were then duly "walked" into Mexico. You'll never guess what happened next.

The Mexican gun cartels used the U.S.-provided guns to kill Mexicans. Lots of Mexicans. The complete death toll is still being tallied.

The Mexican government is beside itself. And ATF has a new acting head.

That's only the beginning. The paper trail for this too-stupid-to-live idea, it's emerging, leads directly into the top level of DOJ - to Attorney General Eric Holder and the head of the Criminal Division, to be precise.

Wait, I'm not done. It gets better.

The trail of e-mails also leads into the White House. and it appears that testimony by Attorney General Holder before the House Judiciary Committee about when he first knew about Operation "Fast and Furious" can reasonably be viewed as being false. In response to a question, Holder said he first heard of it only recently, when the scandal broke. Documents produced this week in response to Congressional subpoenas suggest otherwise.

Oops.

The Obama White House knows it has a real problem on its hands (another one, I mean, besides all the others). The whole thing's going viral as we speak.

"Felony Stupid" has been one description used to describe this Administration's part in and handling of Gunwalker: Fast and Furious.Today comes the news out of Senator Charles Grassley's office that Eric Holder received five (5) e-mails regrding Fast and Furious long before his forked tongued appearance before Darrell Issa's Committee last May.
