MSNBC New Flash: Arizona law "Make it a crime to be an Illegal Immigrant"

Are the people at MSNBC really this stupid?

Doesn't the name Illegal Immigrant make it pretty obvious that if you are one, you're committing a crime?

Rick

Is being an Illegal a criminal offense or more of a civil offense?

Illegal immigration is a crime, hence the word "illegal".

Under Title 8 Section 1325 of the U.S. Code, "Improper Entry by Alien," any citizen of any country other than the United States who:

Enters or attempts to enter the United States at any time or place other than as designated by immigration officers; or

Eludes examination or inspection by immigration officers; or

Attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact;
has committed a federal crime.

Violations are punishable by criminal fines and imprisonment for up to six months. Repeat offenses can bring up to two years in prison. Additional civil fines may be imposed at the discretion of immigration judges, but civil fines do not negate the criminal sanctions or nature of the offense.

Is being an Illegal a criminal offense or more of a civil offense?

Is a civil offense not a crime?

According to wiki (which I really hate citing)
Crimes are generally considered offenses against the public or the state, distinguished from torts which are offenses against private parties that can give rise to a civil cause of action.

Why aren't all those caught over the years gone to prison if it is a criminal offense?

Is speeding a crime? Do we get prison sentences for illegal parking?

So sending illegal immigrants back to their country is now a prison sentence? They are detained until the Federal Immigration authorities decide what to do with them ACCORDING TO FEDERAL LAW!!!!!!!!! What exactly is wrong with that?

Because the punishment for most illegal immigrants is to be sent back to their country of citizenship. Unless there are circumstances that the Federal Authorities decide to use prison as a punishment.

When they're caught they are imprisoned.

The US Justice Department reported that in 2003, alone, 270,000 illegal immigrants had served prison time. The Federation for American Immigration Reform reports: "In March 2000, Congress made public Department of Justice statistics showing that, over the previous five years, the INS had released over 35,000 criminal aliens instead of deporting them. Over 11,000 of those released went on to commit serious crimes, over 1,800 of which were violent ones; including 98 homicides, 142 sexual assaults, and 44 kidnappings. In 2001, thanks to a decision by the Supreme Court, the INS was forced to release into our society over 3,000 criminal aliens who collectively had been convicted of 125 homicides, 387 sex offenses, and 772 assault charges."

The Federal Bureau of Prisons estimates that fully one-third of current prison populations are comprised of non-citizen illegals.

Islamic terrorists, including Mexicans with terrorist ties, have entered and are continuing to enter the US via our unsecured borders.

The violent MS-13 Salvadoran gangs have illegally immigrated across the US-Mexico border. MS-13 has also vowed to kill local police, Border Patrol agents and US citizen-members of the Minutemen project, within the US.

Rick

So...it's NOT a imprisonable crime.

Is that a question?

If it is, I think it's been answered.

From what I am seeing, you're referring to illegals who get arrested for doing ANOTHER crime other than being an illegal immigrant. Yes, then they are imprisoned. But if they are found to be an illegal immigrant without the commission of ANOTHER crime, they are deported.

Excellent question!!!!

Answer is that the Fed Gov is failing in their responsibility. Thats why Arizona is taking care of it themselves... the Fed Gov won't.

Because the Feds have not been enforcing the laws that are on the books. Thankfully, Arizona is going to take care of their state without the inept fed.

Speeding is a crime also. Do you think you should be put in prison for speeding?

Sometimes your stupidity goes beyond the pale.
