More Than 80 Prosecutors In States That Ban Abortion Say They Will Not Enforce Law

District attorneys in more than 10 states where abortion is now banned or likely will be soon have committed to not prosecute people for obtaining abortions, following the Supreme Court’s Friday decision.
“Not all of us agree on a personal or moral level on the issue of abortion. But we stand together in our firm belief that prosecutors have a responsibility to refrain from using limited criminal legal system resources to criminalize personal medical decisions,” their statement says. “As such, we decline to use our offices’ resources to criminalize reproductive health decisions and commit to exercise our well settled discretion and refrain from prosecuting those who seek, provide, or support abortions.”

What happens when you throw a lynching party in a red state, and nobody comes?
So undermining democracy and the rule of law. Sounds like they need to be disbarred.

Well then they won’t be prosecutors long will they. Heck they could make a great carrier out of being a politician won’t they? Hell if they don’t understand the law in the first place what else do they have?

These people are elected County wide not State wide and when you have a big enough Blue city that takes up the majority if not all of the county then you're just shit out of luck. 😄

It doesn't matter. Your county can't violate state law because your county is in that state.

If you only follow laws you approve of, laws are useless.

It is if the state legislatures write laws that it is. You have no idea what you're talking about.
You don't, you dumb mother fucker. That's not what that post was about you dipshit. 😄 Maybe post the whole quote next time so you can understand proper context.

No one is violating state law assclown, prosecutors have always had discretion on which cases to prosecute.

No you stupid shit. Abortion laws are created by the state, not the county. What country do you live in anyhow?

If the state says no abortions allowed after X weeks, then that's the law for all cities, towns, and counties in the state. They don't get to make their own laws if they don't like the state laws. Any prosecutor that refuses to enforce the state law will be prosecuted by the state themselves.

They aren't making laws you dipshit, let me say it s.l.o.w.e.r. for you. Prosecutors. Have. Always. Had. Prosecutorial. Discretion.

But they can't intentionally ignore the law, especially when they've been so verbal about doing it.
Do you not know what the words Prosecutorial discretion means? You know when prosecutors decide to let a kid off with a warning when he's arrested for some weed... same concept.

Discretion doesn't mean intentionally not doing your job out of protest. Police have discretion as well. You get busted going 85 mph in a 65 mph zone, he may give you a ticket for doing 80. That's using discretion. But to overtly state he's refusing to give speeding tickets to anybody will only get him fired and rightfully so.

It's irrelevant though. These people love to put on a dog and pony show just for people like you. When the cases hit their desk, watch how fast they prosecute them once the cameras leave the room.

The road to becoming a practicing attorney is a long and arduous one. After years of law school and months of studying for the bar exam, one more step remains before we are officially licensed to practice. Every lawyer in the country must be sworn in and take their state’s oath of attorney. This ceremony may seem traditional and mundane, but it has never been more important. This oath binds each attorney to certain professional obligations and requires us, as lawyers, to faithfully uphold and support the laws of our state and our country.

The Anatomy of Our Oath

The same thing that would happen if guns were made totally illegal if prosecutors publicly stated they wouldn't prosecute gun owners. The state would fire the prosecutors and enforce the law.

ETA: By the way, if there are no abortion providers, how, exactly, would these procedures occur?

Same way they happened before Roe. OB/GYN performs an abortion, writes something else down on the chart.

Haven't picked on Welfare Ray for a while.

Okay, here's the problem with that. Prostitution is against the law in 49 states. Yet you will find massage parlors, strip joints, escort services, etc where these services are routinely offered. The police know they are there. The prosecutors know they are there. Yet in certain counties, they aren't prosecuted at all.

Sure they can.

Actually, it will probably be the opposite. Prosecutors only really go after cases they know they can win. The problem you have is that when you take such a case in front of a jury, you will have 50% of your potential jury pool that isn't about to convict a doctor much less a woman over an abortion.

You also have the problem of gathering evidence. If an OB/GYN writes down on her chart that it was a miscarriage or he performed an endometrial ablation, how are you going to prove otherwise? Especially with HIPAA laws on the books.

Discretion means just that, they get to decide what cases their office prosecutes. Go cry about it you Simp. 😄
