Cannon's ruling was nearly incoherent. It was going to add far more delay to the investigation than people expect. Just finding the special master and figuring out the parameters for executive privilege was going to take weeks upon weeks of negotiations.

Bad ruling and needs to be overturned at least in part.

No it wasn't. The judge cited numerous cases for precedent.

LOL They took personal info too, such as medical records and lawyer-client privileged documents. The court properly decided the issue.

Garland and the DoJ don't get to decide if a former POTUS has executive privilege especially as there is a SCOTUS ruling saying a former President has executive privilege rights. Nixon v. Administrator of General Services, in which the Supreme Court rejected the government's argument that "only an incumbent president may assert such claims," holding that the former President could also assert the privilege.

The former president does not get to exercise executive privilege against the current president. That's also in Nixon. That's absolutely bonkers to think he could do so. This would be Trump trying to keep administration documents from the administration. It makes zero sense but here we are.

Judge Cannon was making it up as she went along. It's not our legal system I have a problem with. It's judges going off feels rather than law.

Either way, the appeal is smart. The DoJ doesn't say they want to avoid a special master. The special master can go over all the non-classified documents. The DoJ doesn't give a shit about that. They want to investigate the handling of classified information. There is no logical way Trump can claim executive privilege or ownership of the classified documents so there's no rational reason the special master would have to review them anyway.
