A former Schererville bar is not legally liable for a patron being blinded in a parking lot fight after closing time because the attack was not foreseeable, according to a ruling last week by a divided Indiana Supreme Court.

Eric Porterfield, now 45, lost his sight on Dec. 10, 2006 outside Cavanaugh's Sports Bar and Eatery, 1013 W. U.S. 30, when he was attacked for unclear reasons by several other customers sometime after 3 a.m., according to court records.

Porterfield sued the bar for negligence, claiming Cavanaugh's had a duty to protect him because the bar was "located in an area of criminal activity," frequented by individuals "with a propensity to engage in criminal conduct," and had "experienced criminal conduct" for years prior to the attack on Porterfield.

Porterfield, a born-again Baptist missionary who is blind, told the Charleston Gazette-Mail Friday that LGBTQ people are a “modern-day version of the Ku Klux Klan” and reportedly used the world “fa***t” in a committee meeting Wednesday.

Porterfield later defended his comments and joked to a news station that he would drown his children if they were gay.

Yeah. I'm not a legal expert but a bar and a bunch of alcohol fueled patrons getting into a fight in a parking lot? Not going to generate a lot of legal sympathy.
Some of the best drinkers/bar fighters I knew in my younger days were Holy Rollers.
 
Yeah, Porterfield was completely the instigator in the fight. Apparently not aware of the adage about biting off more than he can chew. Of course, being a tub of hate-mongering excrement, he likely figured how much he could chew was related to his general ability at the buffet table.

So, a born-again Baptist missionary is on a bar parking lot fighting at 3AM located in an area of criminal activity and he thinks the BAR is responsible rather than his own lack of judgement? What was he doing in an area of criminal activity at a bar at 3AM in the first place?!

In a sworn deposition taken November 25, 2008, Porterfield stated he and McPherson arrived at Cavanaugh's around 11:00 p.m. on December 9, 2006, after leaving a strip club in Harvey, Illinois. According to the police report, a verbal altercation began shortly after 3:00 a.m. in the bar's parking lot after McPherson touched a woman without her consent. McPherson apologized to the woman, at which point Porterfield approached and asked, "what are you apologizing to this bitch for? You don't have to apologize."Porterfield then asked two of the woman's friends, Jesus Venegas and Jason Dorado, "what are you bitches going to do about it?"Dorado later stated in a sworn deposition that he then saw Porterfield knock down Venegas. According to Dorado, Anthony Acevedo, the woman's cousin, hit Porterfield, leading Dorado to put Porterfield in a headlock. Dorado stated he "poked [Porterfield's] eyes out" after Porterfield bit off part of Dorado's ear.
