Under ARS 13-405, the use of deadly force is sometimes permitted in Arizona. However, it’s limited to narrow circumstances. You can only use deadly force if you’re in reasonable fear of immediate serious physical injury or death. In order to lawfully use deadly force against someone, a reasonable person, in the defendant’s position, would need to believe that deadly force was immediately necessary to protect against potentially deadly force. That’s because self-defense must always be reasonable, proportional, and immediately necessary. Unless you’re faced with the immediate threat of serious physical injury or death, you cannot use deadly force.

If they were unarmed whilst being black or muslim she will be in trouble.

Detectives are continuing their investigation into the shooting and say the attempted break-in does not appear to be random and it could be drug related.

I think they are trying to build a case against this woman....no report yet on the race of the perps...if they were black the media will get involved quickly.

If they were unarmed whilst being black or muslim she will be in trouble.

Doesn’t matter if they were unarmed. They broke into her home and no where for her to go. So sit there and die or shoot the pieces of shit. I don’t care if they were white, black, Spanish, Asian or Muslims. Doesn’t matter. If they were running out of the house and she shot them in the back then yes but that didn’t happen.

I think Arizona should consider implementing the Castle Doctrine.

Normally, deadly force is only allowed when a person reasonably believes that at the time such force was used it was necessary to prevent his/her imminent death or serious bodily injury. Whether the belief was reasonable is for a jury to determine.

However, some states (including Florida where I live) have what is often referred to as the Castle Doctrine whereby a person may use deadly force against anyone who is attempting to break into or has broken into his/her dwelling. In these scenarios, there is a legal PRESUMPTION that the lawful occupant had a reasonable fear of death or serious bodily injury. Here is what the Florida Statutes say:

(2) A person is presumed to have held a reasonable fear of imminent peril of death or great bodily harm to himself or herself or another when using or threatening to use defensive force that is intended or likely to cause death or great bodily harm to another if:

(a) The person against whom the defensive force was used or threatened was in the process of unlawfully and forcefully entering, or had unlawfully and forcibly entered, a dwelling, residence, or occupied vehicle, or if that person had removed or was attempting to remove another against that person’s will from the dwelling, residence, or occupied vehicle; and

(b) The person who uses or threatens to use defensive force knew or had reason to believe that an unlawful and forcible entry or unlawful and forcible act was occurring or had occurred.

In other words, if this had happened in Florida the mere fact they had broken into the lady's home was legal justification for the use of deadly force. Unfortunately, Arizona does not have a Castle Doctrine.

A lot of facts about this case have not been reported yet.....but many do not understand how the law on self defense varies from state to state....everyone should study up on their particulars states law on self defense....but and unfortunately even though the law may be on your side....if it is a controversial case as in white vs. black or muslim the media will get involved big time and pressure will be brought on the city where the event took place ...as in the media goes into a frenzy anytime a whit e uses lethal force to defend their life.

A lot of people running around with a concealed weapon in their pocket who have no idea of what the law on self defense is...thus potentially they are putting themselves into a dangerous position if they do not know the law....and most especially if they do not understand the double standard that now exists when it comes to black vs. white.

If you shoot a black person even if you perceive they are a threat to your life....you may eliminate that threat but then there is the threat of the state ...aka the possibility the state may try to convict you of murder because you shot a innocent black....all blacks now are usually considered innocent by the media...no matter what they are doing and thus they will bring all possible pressure to bear on the city to indict you and put you on trial...the heart of the law on self defense has always been the mindset of the defendant....did they believe they were in reasonable fear of their life?....that is being disregarded in too many cases now.

Homeowners should get the same benefit of police officers. If someone just puts their hand in their pocket, the police are justified in using lethal force. But for homeowners it should go even further, they can easily be outnumbered and just need to be able to shoot first no matter what.

even if she is proven to be their dealer...they still cant invite themselves in at what 3:45 am?
