I notice none of these Senators is arguing that Obamacare is Constitutional. They know it is not.

It is constitutionaol. Republicans are legislating from the bench. Republicans claim legislative supremacy when it is something they want but legislate from the bench when they do not. Roberts has pointed out that Republicans have been able to get rid of Obamacare and now want the courts to do their dirty work.
