A village man is among a group of three accused of cheating an immigrant worker out of a $3 million lottery jackpot.

Zugibe said the purchaser of the ticket lives in the United States illegally and that the three suspects convinced him that attempting to claim the prize would invalidate the winnings and result in his deportation.

Executive Assistant District Attorney Gary Lee Heavener said the man had signed the ticket, leaving the suspects unable to claim the prize. The suspects are believed to have negotiated with the man, promising him a portion of the winnings while convincing him to include them as co-purchasers of the ticket when claiming the prize. Heavener said the man who bought the ticket is entitled to the winnings, regardless of immigration status.

Yes, they should have to pay back the entitlements. Those who commit fraud normally do. Sure, he bought the ticket, his numbers hit so he won. Its his money.

Well, I am a US citizen living in Mexico and while I have my FM3, I am not a citizen yet. If I won the lottery here or $ in a casino, if the $ figure was large enough I would not be entitled to cash in.

Shouldn't it be the same in the US?

I do go to a casino near my home but I am well aware that if I win a large jackpot there is no way I'm collecting. I go to be with friends and kick back for a bit. I suppose one of my friends who are Mexican citizens could collect on my behalf, not sure what I would do to be honest.
 
A winning ticket is a winning ticket. Go ahead and deport them if you want, but the money is still theirs

Not necessarily. They have no SS# to pay their taxes. They should also be forced to pay back the money they stole in benefits and education. You know, like legal US citizens have to do.

You know that you may not get to keep your winnings going into it though. The Lotto folks need to say it up front if they dont want to pay out to illegals.

You can pay taxes without a SS#. You only need an ITIN.

then the rules should be clarified. If someone who is not supposed to be in this country in the first place ... they flat out should be barred from winning.

Agree. Since it's a government thing, however, an ex post facto law attempting to deny him the winnings would be unconstitutional. Legally, I don't see how he can be denied the award, nor any way to recover the funds unless he were guilty of some crime that caused all his property and monies to be forfeited to the State.

If we were to deport him before he chad the chance to collect, I don't think he'd have any legal grounds to object. Are they required to track him down and pay him if he's out of the country and unable to come forward and claim the winnings?

Dude - crossing the border illegally - is a MISDEMEANOR - SHOULD WE DENY LOTTO WINNINGS TO EVERYONE WHO HAS COMMITTED A MISDEMEANOR? If so - you won't have many people buying lotto tickets anymore, will you?

It's not that they're guilty of a misdemeanor. It's not that they're not here legally and therefore should not qualify for participation in any government programs, which would include the lottery.
