Trumps first impeachment trial had every republican vote "not guilty" where they said the reason was that the removal of the president shouldn't be by the judgement of congress, but in the hands of the people in the next election.

Despite lies about voter fraud, the people have voted Trump "guilty", so republicans will need a new reason to ignore the facts of the case. And the case for impeachment is about more than just removal from office, which will be a moot point by the time it goes to trial.

 

The power of Congress to disqualify an impeached president from holding office has received less attention through history than the power of Congress to remove a president from office. The Constitution is clear that after a House majority vote to impeach and a two-thirds Senate vote to convict, the president is removed from office.

Yet Article I Section VII clarifies that removal is not the only punishment impeachment can bring. It reads: “Judgment in Cases of impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States.”

This clause shows definitively that the Senate can inflict a penalty that would prevent Trump from holding office again. Under established Senate practice, that vote to disqualify would require only a simple majority vote in the Senate,

The difference is that they will no longer have their enabler to support them. And by voting "guilty" they have the power to end Trumps political influence as well. If Trump is stripped of being able to run for office, he could longer use his campaign. apparatus.

Actually that would be just one of the impeachment charges. You also have Trumps sedition in telling his supporters to go after the US Capitol Building.

But, while impeachment remains a choice, our government prefers to "look forward, not back." That "precedent" was set when "Watergate" was ignored to let Nixon off the hook, and when "Iran/Contra" was ignored to let Reagan off the hook. Yes, some of those involved in Watergate served time, but no one faced any consequences for Iran/Contra.

So, trump will face no charges for any of his federal crimes, with or without a presidential pardon.
