They should have shipped his sorry ass to Cuba with the rest of the terrorist .. He should not get the same rights as an american citizen he is a terrorist from a foreign country.. He needs a military tribunal not a court case :cuckoo:

The same reason why people who ILLEGALLY enter the United States get free medical care, free housing, a job, food stamps, and free schooling? :eek:
 
Well, considering that detaining people in Gitmo was itself premised on unconstitutional grounds, the proper thing to do is to now maintain the constitutional requirements for this person. BTW, constitutional protections are not due based on a person's citizenship. They are due based on presence within the jurisdiction of the United States.
 
He gets the basic rights of anyone accused of a crime -- a speedy public trial before a jury of his peers, presumption of innocence, the right to appeal -- because that is what the Constitution demands.

Deporting him to a foreign country where he is not guilty of a crime would hardly serve justice. If he's to be tried, convicted, and punished, that has to happen in the place where he is accused of committing the crime, which in this case is the U.S. And there are rules that apply to that, because we believe in due process of law, and are not (yet) a fascist dictatorship.
 
Already been hashed out in court. It was decided foreign terrorists will be allowed the same rights under our Constitution. I don't agree with that ruling but is now the current policy.
 
So far we have had the "Shoe Bomber",, The "Underwear Bomber",, The "Depends Bomber",,hmm, what will they think of next? "The Giant Gerbil Bomber"? hey, at least the fat terrorist wont have any problem hiding the poor little rodent.
