if true, then why do they need the regulation? why aren’t they just doing it?

Generally speaking if a company(ies) that dominant a market segment tell you that they want regulation, it’s either :
A.) to place barriers to entry for potential competitors or to drive smaller competitors out of the market.
B.) to provide cover for some other cost externalizing activity they’re engaged in that is more valuable than the one that said regulation would affect.

Keep in mind WHO writes regulations (unelected bureaucrats) and WHO (special interest lobbies and “think tanks”) has significant input into the language that goes into them. As is always the case with anything that goes on in Washington or State Capitols, the devil is in the DETAILS not on box label.
