Given the fact I've seen police officers from all around the country use this move tells me this is not something he came up with on his own.

If that is the case, why has everyone from the Police Chief down claimed differently?

Lt. Johnny Mercil, the Minneapolis Police Department's use-of-force instructor, testified on Tuesday at former Officer Derek Chauvin's trial that when officers are taught ways to restrain aggressive suspects, they are shown how to place their knee on a back or shoulder and told to "stay away from the neck when possible."

Jody Stiger, a Los Angeles Police Department sergeant, also testified on Tuesday as a prosecution use-of-force expert. Stiger said when Floyd was resisting efforts to get him into a squad car, officers were justified in using force, but once he was on the ground and no longer resisting, officers "should have slowed down or stopped their force as well." After watching video of Floyd's arrest, Stiger said his "opinion was that the force was excessive."

Records submitted to the court on Tuesday show that in 2016, Chauvin took a 40-hour course on how to de-escalate situations involving people in crisis, and in 2018 underwent training in the use of force. Mercil said officers who attended that training were told they needed to use the least amount of force required to get a suspect to cooperate.

Displaying a photo of Chauvin holding his knee on Floyd's neck and looking up at a bystander, prosecutor Steven Schleicher asked Mercil, "Is this an MPD-trained neck restraint?" "No sir," Mercil replied.

He added that a "knee on the neck would be something that does happen in the use of force that is not unauthorized."

How long such a restraint is applied would depend on the level of resistance the subject is offering, Mercil said. When the prosecutor asked if the method would be authorized if someone is under control and handcuffed, he replied, "I would say no."


Mercil also said that in some cases, it might be appropriate to put a knee on someone during handcuffing – and to keep a knee there if the subject is still trying to thrash around or kick people. But he also said that people who are in handcuffs and are in the prone position should be moved either to the recovery position – on their side – or to a sitting or standing position, to avoid positional asphyxiation.

As for when a person who is no longer resisting should be moved from a prone position, Mercil said, "I would say sooner the better."

The police academy does not teach recruits fatal moves. Given the fact I've seen police officers from all around the country use this move tells me this is not something he came up with on his own.
