Jurists unanimously agreed that fetus has the right in estate if two stipulations are met:

1- Actual existence of fetus in his mother's womb at the time of devisor's death. This is can easily be recognized by determining the time of delivery since the devisor's death that is if the mother delivered the baby a month to six months after the death, the minimum period of delivery, then jurists ruled that the baby is worthy of inheritance.

2- The fetus is delivered alive, even if he made one cry, and then died, he/she would be worthy of inheritance. This is the opinion of the majority of scholars. If he/she is born dead, then inheritance is not due, even if the cause of death is a serious offense against the mother.

So long as the fetus is inside the womb, the estate shall not be finally distributed as the fetus gender or number can't yet be identified that is some of the heirs' shares vary according to the gender of the fetus. Accordingly, jurists are unanimously agreed on non-distribution to the estate until time of delivery on condition that the heirs approve it explicitly or implicitly, namely they do not claim it. This is applied to the case when the fetus has no participant heir or even if there such heir but he/she is disinherited. The point of disagreement


among jurists on this topic arises when one of the heirs asks for the distribution of the estate, thus some jurists approve distribution of the estate, others disapproved it, a third view approved distribution to some portion of the estate. In this regard, sheikh Muhammad 'Abdu in his Tafsir "Al-Manar" stated the following: the wisdom behind making the share of man double to that of woman is that man is charged by expenditure on himself and his wife, so he shall receive two shares, while woman only expends on herself and when she get married her expenditure becomes mandatory on her husband.

Taking into consideration that both Quran and Sunnah have paid much attention to setting the right of woman which has always been wronged and protected her against injustice, it would be clear that such claim is completely untrue and bias to the advantages of the Islamic Shari'ah. Some women may argue that they earn their livelihood or the husband is sick to the extent that he is unable totally or partially to provide the livelihood of the family and thus they seek equality in inheritance is void and null, because such cases are not the major rule but they are exception in societies.
Islam takes into account the nature of both man and woman that it views woman as the shepherd on her house affairs and she shall be responsible for that on the Day of Judgment.

We should be aware that Islam does not view woman as an individual, rather it views her and man as one family composed of two persons who are the basic of the whole society, she inherits one share of her devisor and her husband receives two shares of his devisor, and thus the final outcome is three shares for this family; and her brother receives two shares of her father and his wife receives one share of her devisor so that the final outcome is three shares for this other family, there is equality in inheritance.


This is a normal view as the new families are extension of the expired ones; integration is existent between man and woman in the one family whose integration leads to integration to the whole society. Thus there is ground to separate between man and woman, rather they are one entity essential to the welfare of life on earth.
Based on the aforementioned, it becomes clear that Islam does not view woman from the gender perspective concerning inheritance; rather it views her from the social status perspective and the economic burdens she bears as well.

Why are two women witnesses equivalent to only one man?



This question is asked my by many people even by Muslims who don’t have sufficient knowledge about their religion as they consider it as injustice and inequality in Islam concerning woman.

It is not true that two female witnesses are always considered as equal to only one male witness. It is true only certain cases like financial transaction. However, Islam accepts a woman’s testimony as equal to that of a man. In fact, the woman’s testimony can even invalidate the man’s.

The woman’s testimony can even invalidate the man’s. If a man accuses his wife of unchastity, he is required by Quran to swear five times as evidence of the wife is guilt. If the wife denies and swears similarly five times, she is not considered guilty and in either case the marriage is dissolved. God, Almighty, said: “And for those who launch a charge against their spouses, and have (in support) no evidence but their own, their solitary evidence (can be received) if they bear witness four times (with an oath) by God that they are solemnly telling the truth; and the fifth (oath) (should be) that they solemnly invoke the curse of God on themselves if they tell a lie. But it would avert the punishment from the wife, if she bears witness four times (with an oath) By God, that (her husband) is telling a lie; and the fifth (oath) should be that she solemnly invokes the wrath of God on herself if (her accuser) is telling the truth.”(chapter 24: verse 6- 9)

In other cases, women’s testimony is more valid than men. In case of breastfeeding, she is the only one and the more valid to claim that this person is your brother or sister foster. The woman maid is the only who may claim that this boy is the son of certain lady or not. Another example from Prophet Mohammed’s era is the solitary witness of Lady Aisha, prophet’s wife, is a reliable source for many men and women to take Hadiths, the saying of the prophet, as an authentic one. Lady Aisha (may Allah be pleased with her) has narrated no less than 2220 Hadiths (the saying of the prophet) which are considered authentic only on her solitary evidence. This is sufficient proof that one witness of a woman can also be accepted.

Islam gave women rights and privileges at a time when only barbaric manners and values dominated.

Yet, some people argue that Islam has alienated women in some domains. In fact, this belief is a misconception. People who say so, may have read about it in a magazine or seen it on TV. A quick examination of the issues judged as unjust to women will certainly correct the misunderstanding.


Man as the head of the household:


Some people believe that a woman in Islam is regarded as inferior to man since the Quran says (what means):"Men have one degree above women." [Quran 2: 228]




In the Quran it also says (what means): "Men are the protectors and maintainers of women, because Allaah has given the one more than the other and because men support them from their means." [Quran 4:34]


This verse implies that it is a man's duty to support his wife, and not the reverse, but this, in no way, makes him superior to her.


In fact, the rights and responsibilities of a woman are equal to those of a man but they are not necessarily identical. Since men and women are not created identical, they have different physical and emotional qualities, jobs and privileges. This does not mean that women are inferior.


On the contrary, women are considered crucial members of society in Islam since they are assigned the job of bringing up future generations. People today tend to look down at housewives but, in fact, raising children is one of the most important and difficult tasks. The way a mother brings up her child determines the way he will behave in the future. This duty, which requires patience, love, understanding and wisdom was significantly assigned to women in Islam because her nature suits this job.


Allaah The Exalted, in His Wisdom, has assigned a role for each member of the family so that there would be no arguments concerning who should do what. If a sailboat has two leaders, each will want to follow a path, leading ultimately to chaos and even a crash. In the same manner, how many times have your parents fought over some decision because each had their own point of view and wanted to apply it? This is precisely why it is preferable to have one leader for each household. However, this does not give the leader the right to be a dictator, or to neglect the role of his companion. This does not make him superior to other members of his family. It just gives him a larger duty.


Inheritance:


Some people claim that Islam is unjust towards women because it entitles them to inherit half of what men get. In fact, those people only know one side of the truth.


First, the principle of women inheriting half the money is only applicable in 45 percent of the cases. In the other 55 percent, women inherit the same amount or sometimes even more. For example, a mother and a father each inherit the sixth of their son's property when they are not the only inheritors.


In addition, the laws of inheritance in Islam are proportional to the duties of spending. Indeed, a man in Islam has the responsibility of supporting his family, his brother's children (when his brother dies), his parents (when they retire and do not have an income), his children from his previous marriage (if he has them) and his household, including his wife and children. A woman, on the other hand, does not bear this responsibility. She has the freedom to use the money she collects from her dowry or work as she pleases.


You might object here, saying that women today are working and helping their husbands pay the expenses, which entitles them to share equality with men. In fact, you should know that women's economic assistance to their husbands, which has become the norm today, is only an answer to the females’ wishes. Islam does not oblige women to spend on their households. It is a free choice many women have themselves taken today to feel more liberated, so it does not entitle them to a bigger portion of the inheritance


Polygyny:


Polygyny is one of the most questioned principles that Islam grants men and women. Indeed, many people wrongfully accuse Islam of injustice because it allows a man to have up to four wives. Nevertheless, like every instruction in the Quran, polygyny has a reason. You see, Islam is a practical religion that acknowledges the needs and temptations of human beings and provides laws that deal with them, thus preserving harmony and morality.


- Polygyny might be the solution for a couple if the wife is barren, the husband wants children of his own and the option of separation does not appeal to both parties.


- If a woman is chronically ill and is unable to perform her marital duties. Polygyny may also be the solution when the couple does not want divorce.


- Polygyny is the religion's answer to cases where some men have excessive sexual needs that cannot be fulfilled by one wife. This in no way means that men should abuse this right and use it whenever they fancy a woman. It is rather a chance Islam has provided to prevent men from committing adultery. Many people who condemn polygyny cheat on their wives, calling this phenomenon a 'swift affair.' Islam, at least, has offered the second woman the option of being called 'a wife' rather than 'a mistress', especially in some countries where women remarkably outnumber men.


- Polygyny may settle the problem of an increased number of unmarried women, especially during wars.


However, polygyny has some limits and conditions to be met. Indeed, the Quran instructs the man to be fair with his wives on all levels, including treatment, money, house, etc. The only level where the man may have an uneven stance is the level of the feelings that he cannot control:


The Quran says (what means): "You will never be able to do perfect justice between wives even if it is your ardent desire, so do not incline too much to one of them [by giving her more of your time and provision] so as to leave the other hanging [i.e. neither divorced nor married]. And if you do justice, and do all that is right and fear Allaah by keeping away from all that is wrong, then Allaah is Ever-Forgiving and All-Merciful." [Quran 4:129]


Finally, it is worth knowing that Islam gives a woman the right to refuse polygyny for her husband by setting it as a condition during the marriage procedures. If this condition is set, then the woman is granted divorce if her husband marries another while he is still married to her.


You might ask, why could not there be polyandry (a woman having more than one husband)? The answer is simple. Islam did not allow it because Allaah is All-Aware that it will create a problem of kinship. This means that the child may not know who is actually his father (it could be anyone of the four husbands). In addition to the psychological damage it may cause, this problem also complicates the issue of inheritance. Even birds and animals do not allow polyandry.




This is the status of women in Islam; where terrestrial systems of systems of Islam just heavenly, Terrestrial systems does not sponsor women's dignity, since disowned the father of his daughter, while the age of eighteen years or less; to go out wandering on her face


Islam has honored women, and make it honorable man unlike systems that prepared the source of sin, and take away their right to ownership and responsibility, and makes them live in humiliation and contempt, and prepared by the unclean creature?.


Islam has honored women on the reverse of making women a commodity trading her body in propaganda and advertising?.

Islam has honored women in contrast to systems that are transmitted to swear allegiance to a deal to marry a wife; to be a property of the husband? Some even held their synagogues; to consider the fact whether it is women and the spirit of human beings or not? !.

Thus we see that Muslim women in worldly terms happy with her family in the confines of her parents, and care for her husband, her children, whether dander in the event of her childhood, or youth, or Hermha, and if their poverty or richness, or her health or her illness.


If there is shortening of the right of women in some Muslim countries, or of some to associate Islam - he is a failure because of ignorance, and distance from the application of the laws of religion, and the burden in on the mistake and religion is unconnected with the consequences of those shortcomings.

The remedy for that error can only be by reference to the guidance of Islam and its teachings; for the treatment of error.

The share at best be in shelters, and the role of the infirm and the elderly; where visited and ask them.

And may have a share of the pension, or the like, shall devour him until you die; the womb is not there, and no link does not close the Crown.

In this scientific age, we explore the significance of this legislation. Actually, this injunction is in perfect harmony with the nature and psychology of the woman as seen in psychologists, psychiatrists, and medical research.

As women, we are aware of the cyclical psychological strains that a woman has to encounter every month. The symptoms during early pregnancy, ante- natal, post- natal, depression, the phenomenon of menopause, the physiological and psychological problems due to infertility and the problems faced after miscarriage.

It is under these situations that women can experience extraordinary psychological strains giving rise to depression, lack of concentration, slow- mindedness and short term memory loss. Psychiatry in practice, April 1983 issue states: “Forty percent of women suffer from pre- menstrual syndrome…..”

The length review portrays how female behavior is affected in these situations. In the pre- menstrual syndrome: C. Shreeves writes: “Reduced powers of concentration and memory are familiar aspects of the pre- menstrual syndrome…..”


This doesn’t mean, of course, that women are mentally deficient absolutely. “Reduced powers of concentration and memory are familiar aspects of the pre- menstrual syndrome and can only be remedied by treating the underlying complaint." This does not mean, of course, that women are mentally deficient absolutely. It just means that their mental faculties can become affected at certain times in the biological cycle. Shreeves also writes: "As many as 80 percent of women are aware of some degree of pre-menstrual changes, 40 percent are substantially disturbed by them, and between 10 and 20 percent are seriously disabled as a result of the syndrome.”

We read in Psychological Medicine: "Many studies have reported an increased likelihood of various negative affects during the pre-menstrual period. In this affective category are many emotional designations including irritability, depression, tension, anxiety, sadness, insecurity, lethargy, loneliness, tearfulness, fatigue, restlessness and changes of mood. In the majority of studies, investigators have found it difficult to distinguish between various negative affects, and only a few have allowed themselves to be excessively concerned with the differences which might or might not exist between affective symptoms." Psychological Medicine, Monograph Supplement 4, 1983, Cambridge University Press, p.6.

Post- natal depression


There are considerable sleep difficulties. The mothers lose interest in the things they enjoyed prior to the baby's birth, and find that their concentration is impaired. They often feel irrational guilt, and blame themselves for being 'bad' wives and mothers. Fifty percent of these women are not identified as having a depressive illness. Unfortunately, many of them do not understand what ails them and blame their husbands, their babies or themselves until the relationships are strained to an alarming degree." Menopause


This phase in a woman's life can start at any time from the mid-thirties to the mid-fifties and can last for as long as 15 years. In this phase, many women pass with many various psychological changes that may affect their mental capabilities.

It is a common misconception with some non-Muslims that Islam would not have millions of adherents all over the world, if it had not been spread by the use of force.

The following points will make it clear, that far from being spread by the sword, it was the inherent force of truth, reason and logic that was responsible for the rapid spread of Islam.

Islam has always given respect and freedom of religion to all faiths. Freedom of religion is ordained in the Quran itself:

“There shall be no compulsion in [acceptance of] the religion. The right course has become clear from the wrong.” (Quran 2:256)



The noted historian De Lacy O’Leary wrote:[1] “History makes it clear however, that the legend of fanatical Muslims sweeping through the world and forcing Islam at the point of the sword upon conquered races is one of the most fantastically absurd myths that historians have ever repeated.”

The famous historian, Thomas Carlyle, in his book Heroes and Hero worship, refers to this misconception about the spread of Islam: “The sword indeed, but where will you get your sword? Every new opinion, at its starting is precisely in a minority of one; in one man’s head alone. There it dwells as yet. One man alone of the whole world believes it, there is one man against all men. That he takes a sword and tries to propagate with that will do little for him. You must get your sword! On the whole, a thing will propagate itself as it can.”



If Islam was spread by the sword, it was the sword of intellect and convincing arguments. It is this sword that conquers the hearts and minds of people. The Quran says in this connection:

“Invite to the way of your Lord with wisdom and good instruction, and argue with them in a way that is best.” (Quran 16:125)

The facts speak for themselves

• Indonesia is the country that has the largest number of Muslims in the world, and the majority of people in Malaysia are Muslims. But, no Muslim army ever went to Indonesia or Malaysia. It is an established historical fact that Indonesia entered Islam not due to war, but because of its moral



message. Despite the disappearance of Islamic government from many regions once ruled by it, their original inhabitants have remained Muslims. Moreover, they carried the message of truth, inviting others to it as well, and in so doing endured harm, affliction and oppression. The same can be said for those in the regions of Syria and Jordan, Egypt, Iraq, North Africa, Asia, the Balkans and in Spain. This shows that the effect of Islam on the population was one of moral conviction, in contrast to occupation by western colonialists, finally compelled to leave lands whose peoples held only memories of affliction, sorrow, subjugation and oppression.

• Muslims ruled Spain (Andalusia) for about 800 years. During this period the Christians and Jews enjoyed freedom to practice their respective religions, and this is a documented historical fact.




• Christian and Jewish minorities have survived in the Muslim lands of the Middle East for centuries. Countries such as Egypt, Morocco, Palestine, Lebanon, Syria, and Jordan all have significant Christian and Jewish populations.

• Muslims ruled India for about a thousand years, and therefore had the power to force each and every non-Muslim of India to convert to Islam, but they did not, and thus more than 80% of the Indian population remains non-Muslim.

• Similarly, Islam spread rapidly on the East Coast of Africa. And likewise no Muslim army was ever dispatched to the East Coast of Africa.



• An article in Reader’s Digest ‘Almanac’, yearbook 1986, gives the statistics of the increase of the percentage of the major religions of the world in half a century from 1934 to 1984. This article also appeared in The Plain Truth magazine. At the top was Islam, which increased by 235%, while Christianity had increased by 47%. During this fifty-year period, there was no “Islamic conquest” yet Islam spread at an extraordinary rate.

• Today the fastest growing religion in America and Europe is Islam. The Muslims in these lands are a minority. The only sword they have in their possession is the sword of truth. It is this sword that is converting thousands to Islam.




• Islamic law protects the privileged status of minorities, and that is why non-Muslim places of worship have flourished all over the Islamic world. Islamic law also allows non-Muslim minorities to set up their own courts, which implement family laws drawn up by the minorities themselves. The life and property of all citizens in an Islamic state are considered sacred whether they are Muslims or not.

Conclusion

It is clear, therefore, that Islam did not spread by the sword. The “sword of Islam” did not convert all the non-Muslim minorities in Muslim countries. In India, where Muslims ruled for 800 years, they are still a minority. In the U.S.A., Islam is the fastest growing religion and has over six million followers.

In his book The World’s Religions, Huston Smith discusses how the prophet Muhammad granted freedom of religion to the Jews and Christians under Muslim rule:




The Prophet had a document drawn up in which he stipulated that Jews and Christians “shall be protected from all insults and harm; they shall have an equal right with our own people to our assistance and good offices,” and further, “they shall practice their religion as freely as the Muslims.”[2]
