District of Columbia Mayor Vincent Gray on Wednesday signed an executive order instructing police officers not to question people about their immigration status -- even people who are arrested on other matters -- unless immigration status is directly related to a criminal investigation.

"The district is home to thousands of immigrants," he added. "If they are afraid to cooperate with authorities on criminal investigations because they fear it might endanger their presence in the United States or the presence of a loved one, then it endangers their public safety and that of our entire city."

The mayor’s order comports with Constitutional case law.

The Court ruled that every person, including undocumented aliens, are entitled to due process per the 14th Amendment.

Because rights are inalienable they can be taken by no man or government. In the case of illegal aliens, no government agency, such as DHS or DC City Hall, may make a legal determination as to the due process rights of a given person in American jurisdiction, that only the courts may do.

Consequently the designation of a person as ‘undocumented’ is irrelevant with regard to due process.

In order for a person suspected of being in the country illegally to be subject to detention or a given punitive measure – such as not being allowed to attend school – he must first be found guilty of that crime in a court of law. The police can’t stop and interrogate an individual because he ‘looks illegal.’

In essence, the Court correctly determined that the government has no authority determining who will or will not have his rights.

WA D.C. has always been on its way to self-destruct. This just puts another nail on its coffin.
 
That's the best news I've heard in a long time. All the illegals should leave Alabama and go to DC.
