A Florida Federal District Court judge recently ruled that the extended CDC mask mandate had to go because (1) it violated the Administrative Procedures Act because it was not published for comment, etc., and (2) because the statutory provision on which it was based addresses "sanitation," which means that the mandate was a perversion of the statute. The ruling did not address whether it was good public policy or scientifically justified, because that's not her job. She pointed out that if CONGRESS wants to do this, or to authorize the CDC to do this, they have the power to do so, but thus far they have not.


Immediately, the entire Leftist media began to attack the judge and her "illegitimate" ruling because,
  • She was a Trump appointee,
  • This may work against vulnerable people,
  • "Masks work," and
  • She clerked for Clarence Thomas in a previous life.
This always happens with Leftists. When something is done that they don't like, they refuse to look at the actual basis for what is done - which is usually technical/legal - and rail that it was not a good idea. CONGRESS is where it should be decided whether it is a good idea, not in a Court. They are so accustomed to judges ignoring the law and the Constitution to rule the way they want to rule, that they cannot grasp it when someone actually cites the underlying document and says, "You can't do that."
