ahmaund arbery trial getting closer

Definition of deputizing......'
What does being deputized mean?
'to give (someone) the power to do something in place of another person : to make (someone) a deputy. : to act in place of another person : to act for someone as a deputy.' Thus the police instead of telling people in that neighborhood they would monitor the problem....told them to call Gregory McMichaels.
I'm not trying to be ass, but your comment above would have more weight if you included a hyperlink to the site where you obtained this definition and also, if you used a state law (statute) that spells out how and by whom one can be deputized.

From what I've reach about this story, individuals in the Neighborhood Watch have more state sanctioned "authority" than this story of someone having deputized the elder McMichael to carry out certain acts under "color of law". In his case he probably would have been screwed either way because he had been stripped of certain of his police powers shortly before opting to retire from law enforcement.

It's generally unlawful to impersonate a police officer and/or to attempt to carry out activities which only law enforcement officers are allowed to do (like detaining someone or attempting to arrest them for a non-felony which was not personally witnessed).

What police powers was McMichaels allegedly stripped of and why did the police tell people to contact McMichaels about the problems that people in the neighborhood were so concerned about?

McMichaels did not impersonate a police officer nor did he arrest or attempt to arrest anyone.

Irregardless, even private citizens can follow or pursue criminal suspects.

Also not to forget that the law on citizens arrest was changed after this incident....and in fact changed to make the prosecution of McMichaels easier.

Thus we see that the 'political fix' is very strong to essentially lynch some honorable citizens trying to protect their community.

As has been said....we cannot expect a fair trial in this case, we cannot expect an un-biased Judge, nor can we expect a competent un-biased jury.

The defense team should have requested the trial to be moved to another city.....Brunswick is under too much pressure from the Feds to insure a fair trial.

IT IS VERY LIKELY WE WILL SEE A MIS-CARRIAGE OF JUSTICE IN THIS CASE.

Ahmaud Arbery’s Accused Killer Was Barred From Making Arrests After Skipping Use-of-Force Training
Gregory McMichael, the former Georgia police detective charged in the fatal shooting of 25-year-old Ahmaud Arbery, was stripped of his law-enforcement certification last February after failing to complete required use-of-force courses, records state.

Records first obtained by The Washington Post show that McMichael, 64, lost his power to arrest after repeatedly failing to complete required training sessions—even after a 2014 warning that he had not finished mandatory force and firearms courses.

During his 37-year career in law enforcement, McMichael was stripped of his law-enforcement powers twice: Once in January 2006 after an undisclosed infraction and again in February 2019 after the Georgia Peace Officer Stands and Training Council (POST) suspended him for “failure to maintain training for the year.”

In all, McMichael had fallen short in various types of training hours in 2005, 2006, 2007, 2009, and 2010—and did not complete the mandatory use-of-force and firearms training for at least three of those years, the documents from the Brunswick Judicial Circuit District Attorney’s Office state.

“This situation has been a great embarrassment to me and to Investigator McMichael,” Brunswick District Attorney Jackie Johnson wrote in a June 2014 letter to the Georgia POST director. “It has negatively impacted my office, and I have taken measures to ensure that it doesn’t happen again. Please accept my sincere apology.”

The former police detective whose actions in the fatal shooting of Ahmaud Arbery in Georgia were defended as a citizen’s arrest was stripped of his law enforcement certification and power to arrest a year before the deadly encounter, according to personnel records acquired by The Washington Post.

Gregory McMichael’s certification was suspended in February 2019 after repeated failures to complete required training, according to documents from the Brunswick Judicial Circuit District Attorney’s Office, including a warning in 2014 that McMichael had neglected to finish mandatory firearms and use-of-force courses.
McMichael, 64, and his son Travis McMichael, 34, were arrested last week and charged with murder and aggravated assault in Arbery’s death, more than two months after the fatal shooting. Arbery’s family says the 25-year-old black man was out for a jog when he was chased by the McMichaels, who are white and were armed.

Gregory McMichael told police they believed Arbery was involved in local burglaries. A video shows a man who is believed to be Arbery entering a house under construction moments before the shooting, though the property owner says nothing was taken.

The case, which reignited national conversations about policing and race after a video of Arbery’s death went viral, has been passed to four different prosecutors. Two recused themselves because of past professional connections with the elder McMichael, who worked for the Glynn County Police Department and the Brunswick Judicial Circuit, both of which have jurisdiction over the neighborhood where Arbery was killed.

One of those prosecutors, George E. Barnhill of the Waycross Judicial Circuit, took an unusual step while recusing himself, writing a letter to the local police department arguing that the McMichaels’ actions were lawful under Georgia’s citizen’s arrest and self-defense statutes because they thought Arbery was a burglary suspect.

Elizabeth Graddy, an attorney for property owner Larry English, released a video clip believed to show Ahmaud Arbery before he was killed on Feb. 23. (Attorney for Larry English)
Before Barnhill’s recusal, Jackie Johnson, district attorney for the Brunswick Judicial Circuit, recused herself in February because McMichael had been an investigator in her office from 1995 through 2019.

Two Glynn County commissioners have said that Johnson’s office told police investigators to refrain from arresting the McMichaels in the hours after Arbery was killed, an allegation Johnson has denied.
Gregory McMichael’s personnel documents provide an incomplete account of his employment history with Glynn County, but they indicate that he was stripped of his powers to arrest people on at least two occasions: once beginning in January 2006 — because of an undisclosed infraction the previous year — and again in February 2019, when the Georgia Peace Officer Standards and Training Council (POST) issued a suspension order for “failure to maintain training for the year 2018.”

McMichael retired in June, four months after the suspension of his law enforcement certification. He is being held at the Glynn County Detention Center, along with his son, and could not be reached for comment.

His attorneys, Frank and Laura Hogue, did not provide comment on McMichael’s personnel records. But they released a statement Thursday saying there has been “a rush to judgment” about Arbery’s death.

A person cannot be prosecuted for something that was not unlawful at the time the act was committed, if I'm not mistaken that's part of our Constitutional protections.

A private citizen can do all sorts of things but that doesn't shield them from someone attempting to charge them with violations of the state's stalking, harassment or other laws or having a lawsuit filed against them. And following someone is one thing but attempting to force them to stop and talk to you, blocking their pathway in an attempt coerce their behavior, accosting them while openly carrying a weapon, all of these things often are seen as "threats" which can be violations of the criminal code. Those types of things can also cause escalations as we see in this case.

The McMichaels are fortunate that their target was not armed himself.

Call the police, tell them you're being followed, threated and harassed by "3 white males in two pickup trucks and that they've been chasing you for the last x number of minutes and attempted to demand that you stop jogging and talk to them". Give them their license plates if you can.

All of this will be recorded on the 911 line and if you have to use your weapon for self-defense, the police will have the info you relayed to the dispatcher to support your claim of self-defense.

Turn on the recorder on your phone and let it record everything that is going on, even if it's only a voice recording from your pocket. Better yet, the ACLU has an app that you can download on your phone that you can activate when the police stop you (or idiots pretending to be the police) and records to a secure server on one of the ACLU's sites so that even if the police or someone else take your phone and/or delete your recordings of them, there should be a secure copy of the recording file in the possession of the ACLU that you can later retrieve.

Better prepared than not I say, but it's up to each person if they want to go to these lengths in order to protect their lives/freedom/rights.

According to the personnel documents, McMichael fought to keep his arrest powers several times after skipping out on trainings—writing in 2014 that the missed hours were the result of numerous health issues he and his wife had suffered from in 2006 and again in 2009.

“Again I do not offer this information as an excuse, I knew full well that I was responsible for attending the proper amount of training but failed to do so,” McMichael wrote in his waiver application to the training council. “The years 2006 through 2009 were a very difficult period in my life. I allowed the difficulty of the situation to cloud my judgment.”

The 64-year-old’s waiver was granted, according to the records, and he continued to serve as an investigator in Johnson’s office

This illustrates a common problem with police officers over-burdened with paper work, training requirements etc. and at his age being close to his retirement he was probably just tired of it all...kinda burnt out and grew negligent regarding paperwork, the required training etc.

So in your opinion, they should not have been charged for killing Ahmaud, let alone convicted?

Nothing Ahmaud is alleged to have done, not the trespassing, the jogging, nor charging one of the men who had been following him, used their vehicle to bump into him, etc. were crimes for which the punishment is death.

Attempting to defend yourself against someone who confronts you carrying a shotgun after having forced you to stop is not unlawful.

Creating a situation where you force another person to defend themself against you while you're armed doesn't lawfully allow you to shoot and kill them since you instigated the situation. This is not allowed by every self-defense law in all 50 states.

Which brings up the question why did ahmaud not call the police if he felt his life was in danger?

Irregardless and again....no attempt was made to arrest or detain ahmaud.

If the McMichaels had wanted to arrest ahmaud all they would have needed to do was to get out of their truck when they first caught up with him and pulled out their weapons and ordered him to get on the ground.

McMichaels did say that when they began the pursuit they intended to make a citizens arrest but they did not attempt to do that.

McMichaels said they decided to just keep Ahmaud under observation till the police arrived on the scene....and the neighbor said he used his vehicle to attempt to slow down Arberrys attempt to get away.

Greg McMichaels with 30 yrs of police work behind him knew how to do all that and had doubtless done it many times....instead they just told him to stop they needed to talk to him.....ahmaud just kept on running.....so the McMichaels pulled ahead of him and you can see on the video at least a 100 yds ahead of him

and Greg McMichaels got on his phone and called the police to advise them of the situation.

Travis McMichaels got out of the truck and stood to the left and front of the truck with his shotgun.

Whilst greg was still on the phone to the police ahmaud ran up and proceeded to assault Travis...punching and wrestling with him.

If ahmaud was in fear of his life he would not have continued running towards the MacMichaels who were at leat a 100 yards in front of him in their parked truck...the video clearly shows that.

The McMichaels were parked there waiting on the police to get there and to keep ahmaud under observation whilst Greg was on the phone to the police.

Neither of them had their weapons pointed at Ahmaud who runs up to the truck and jogs around the right side of the truck and then darts left very quickly and attacks Travis....Ahmaud had several options ....he could have just kept on jogging, he could have run in a different direction....the guy following was just videotaping the incident and was unarmed.

He could also have called the police himself at any time if he felt he was in danger.

While I don't necessarily disagree that having to fill out paperwork and performing annual certification and training can be a pain, the public has the right to want to feel confident in the knowledge that our law enforcement officers are properly trained and their certification paperwork is in order.

Many of the bad shootings by the police are automatically written off as "lack of training" but if the officers view their training merely as a requirement they need to comply with instead of actually taking to heart what they're being taught then we should have a lower incidence of police shooting, but that's rarely the case.

This occurs in all professions unfortunately, some people join the police force simply for the paycheck and a job that allows them to rule over others, holding the power of life & death and freedom in their hands.

Thankfully not all of them are that way but all it takes is a few to ruin the lives of others who don't have the legal right and often times the financial means to fight against them when they are being abused and the officers are violating their oath.

In this case, I think the elder McMichael's years of working law enforcement caused him to behave the way police detectives automatically do when they have a "suspect" in their sights who they want to "apprehend".

The bottom line though is that this was the wrong course of action and because they chose to do this someone died, unnecessarily.

The part you're missing is that they had NO LEGAL AUTHORITY to do ANY of the things they did. NONE!

It's one thing when a police car is behind you, telling you to pull over, flashing his lights and siren at you and an officer gets out and comes over to your vehicle to talk to you - that's legal.

A couple of guys in a pick-up truck yelling at you as you're jogging along, telling you to stop, that they want to talk to you and when you don't stop, they bump you with their vehicle and keep cutting you off by obstructing your path. NONE OF THAT IS LEGAL

That's why they're in jail and will hopefully be convicted, because what they did was not legal, especially the part where Ahmaud was shot and killed by them, not because there is some grand conspiracy to railroad them.

Yelling at some one is not a crime....telling someone to stop is not a crime ....following a suspect is not a crime...telling someone you need to talk to them is not a crime.....whether or not the suspect was accidentally bumped into is a matter of conjecture....and no doubts forensic experts will offer their opinions and highly unlikely they will agree on that.

Above all none of the above gave the suspect the right to assault Travis McMichael which forced Travis to defend himself....which is clearly seen on the video.

You have bought into the emotional b.s. of the msm whose intent and purpose was to hype this into a racial matter when race played no role.....it was a simple case of a fleeing suspect being pursued and the suspect attacking Travis for no good reason...perhaps Ahmaud was having a hallucination of which he was known to have...his mental problems are a matter of record....his aggressiveness towards the police is also documented and that video has been posted on here.

Perhaps since he was on probation he feared going back to jail and became enraged ...who knows...no one can read ahmauds mind as in no one really knows why he did what he did....all we know--- everything from trespassing on private property to attacking Travis ---in the final analysis is bizarre.

Any un-biased and competent jury will have no trouble sorting out the truth...just like in the Zimmerman case....all the emotional hype and lying was seen through by the jury and all those like you that thought Z would be rotting in prison today were proved wrong and if justice is done in this case the accused will be acquitted just like Z was.

If you do all that while armed it is. The threat in that is implied.

No weapons were displayed until they parked their truck way down the road and Travis got out with his shotgun....and Gregory got into the back of the pickup to call the police.

Ahmaud saw the weapons but he continued running towards the MacMichals....something no one in fear of their life would have done.

He knew they had no intent to shoot him or they would already have done so....he could have just kept running on down the road and he would be alive today....but he decided to attack---thus he caused his own death.

Perhaps he wanted to die.....he was a very troubled person....you can see that quite easily on the posted video of his previous encounter with the police.

You don't know that no guns were displayed before the snippet of video you saw. What is a fact is that they had guns and that they chased Arbery down and tried to detain him. That's otherwised known as armed kidnapping. Just because you think you have a good reason doesn't make armed kidnapping any more legal.
Ahmaud saw the weapons but he continued run towards the MacMichals....somerhing someone in fear of their life would have done.
Arbery was caught between the McMichaels who he was jogging towards after they pulled in front of him, and Roddie behind him who was doing the filming. Maybe he just didn't want to turn his back on armed kidnappers and decided to make his stand there.

The cause of his death were racist fuck hats who are going to spend the rest of their lives getting bent over by the brother's in prison.
Perhaps he wanted to die.....he was a very troubled person....you can see that quite easily on the posted video of his previous encounter with the police.
And perhaps these racists really just wanted to engage in rough prison sex. Lol.

Nonsense....no attempt to detain him was made....chasing someone is not a crime....he had freedom of movement at all times. No jury would ever consider this an attempt to kidnap....ridiculous analysis.

Ahmaud was not caught....he was jogging freely down the road....he could have gone in many different directions...he could have stopped and called the police...he could have knocked on someones door and asked for help if he felt threatened.

One can speculate endlessly regarding ahmauds motives and none of them make any sense ....from walking around in a vacant house at night with a dazed look on his face to attacking a man armed with a shotgun....not the behavior of a sane person.

A couple problems. First. The statements of the McMichaels and Roddy to the cops. They said they tried to stop Arbury and that they blocked his path. That is a crime.

Second. Telling someone to stop while armed is Aggravated Assault in Georgia. That is also a crime.

Third. Self defense does not apply while you are committing the crimes.

So your arguments for the defense that make it simple don’t actually apply.

Sorry, the courts and normal people don't play those stupid games. It recognizes the difference between someone jogging up to you non threatening and saying they need to talk to you and someone running up on you or chasing you down with a knife or gun in their hands saying I need to talk to you. You want to pretend you're a moron go ahead but the law isn't going to see it that way.

They said they told him to stop that they needed to talk to him.

His path was not blocked he had plenty of room to keep running which he did.

Post the law on aggravated assault in Georgia.

here it is and you are wrong...Aggravated Assault Charges in Georgi

What the prosecutors are doing is throwing a lot of crap up against the wall and hope something sticks.

They will be laughed out of town.

When they caught up with Ahmaud no weapons were displayed....Travis was driving and his shot gun was not displayed nor was the pistol carried by the father displayed.....the weapons were for self defense and nothing more.....they simply drove up next to Ahmaud rolled down the window and requested ahmaud to stop they needed to talk to him......they knew he was simply a suspect and nothing more....they did not need to go full force....they just wanted an explanation for why he was in the house under construction.

Gregory had 30 yrs. of police experience and knew when to use a gun or when not to....he had never fired his weapon in all that time......he opted out of trying to make a citizens arrest....and just let the police handle it....after ahmaud refused to co-operate they just decided to keep him under observation and let the police handle it.
