The nineth amendment states that any rights stated in the constitution can be construed to deny the ones retained by the people. I assume that when they say rights in the constitution they are referring to powers delegated to the government so any power the government has can't be used to step on ones retained by the people.

Now I think I retain the right not to buy health insurance but Obama thinks he is being smart by using the IRS to enforce it so he can say that he is simply taxing people which is a right the government has. However, it seems the nineth amendment prevents the federal government from using this power to infringe on my right not to buy health insurance (or to even participate in this stupid law).
