Suppose on election day Mitt wins 269 and Obama 269.

No candidate has a majority. The vote goes to the House.

But the electors don't cast the actual vote until December 15th. There are 24 states that have laws to punish faithless electors. The rest do not. An elector may cast his vote for any eligible citizens he chooses, so long as each of the two are from different states. Further, an elector in a state which punishes his for voting against his pledge will still be able to cast a faithless vote and it will be counted - he will just have to face a punishment imposed by his state.

Given that the election will definitively go to the House unless one elector that is pledged to Obama votes for Romney instead or vice versa - at this point the electors may change their votes up to influence the remainder of the process.


Since the House picks from the top 3 candidates for President, even even a single elector votes for a 3rd party candidate - such as Gary Johson - the House will get to choose from Romney, Obama, and that 3rd party candidate. Given only the choice of Obama and Romney, its clear the House would pick Romney. But - if a third party choice of Gary Johnson is available and constituent support demands it, some of those teabag morons in the House may go for Gary Johnson instead.

So - if the electoral college vote is 269 ROmney 268 Obama 1 Gary Johnson, with the Johnson vote being cast by a faithless Obama elector with the express purpose of splitting the House vote - and the House vote is successfully split - it is sufficient to deny Romney 25 state delegations, whether they vote for Obama or Johnson or split and cast no vote does not matter - then the House will be unable to choose a President!


Then whomever the Senate picks as VP would Act as President!

Ryan if the Senate is Republican - but BIDEN if it is Democrat?

Not so fast!

The faithless electors could further influence the election.

Say the electoral vote is 269 Romney 134 Obama 135 Johnson, with 135 faithless Democrat electors switching their votes from Obama to Johson for President. Say this deadlocks the house because the teabaggers refuse to budge from Johnson.

Now say those 135 electors also switch their VP vote to OBAMA. Then the vote for VP is 269 Ryan 135 Obama 134 Biden - the Senate chooses from the top TWO candidates so if they are Democratic, Obama would be the choice! Then Obama would hold the office of Vice President, but he would Act as President since the Office of PResident would be vacant until the House came out of deadlock.
 
Well, it makes me wish even more that Obama gets his butt kicked...:wink_2:

The electoral college is a way to ensure that the smaller less populated states have an equal say as the larger more populated states.

If it were decided on popular vote, the Presidency could be decided by the population of only 9 states.

In my opinion, each state should only count as 1 vote, that would give each state the exact same voice when it comes to the office of President.

OR

We could just let the state legislatures decide who becomes President....after all there is no Constitutional right to vote for President.
 
A right not enumerated remains a right.

The House of Representatives is democratically elected and has the greater power as all money used must go through it. The Senate is there to balance protection of the small vs the big.

The president represents all the people. All the people should vote for the post.
 
Your assuming that the Tea Party in the House will vote for Gary Johnson.
Tea Party is not for a third party candidate. They are working to change the way business is done up in Washington through the two party system.
The Tea Party Representatives will vote for who voted in the majority of their districts. That would be Gov. Romney.

Actually its a way of ensuring that people in less populous states have MORE of a say than people in more pupulous states. For instance, the voter in Vermont has 3x more say than the voter in Texas.

Sure, if 100% of all nine states all voted for one candidate. That would be a majority of American all voting for one candidate. How horrible it would be if a majority of Americans all picked the same guy and he got to be President, right? That would be a slap in the face to Democracy.

And its definitely possible in a reasonable person's world that California, Texas, New York, Florida, Illinois, Pennsylvania, Ohio, Michigan, and Georgia would have 100% of their citizens all vote for the same person, right? I mean, California, Texas, New York, and Georgia ALWAYS vote in LOCKSTEP with each other - in MORON WORLD maybe.

Then you would not have ratified the U.S. Constitution, would you have?

Why not let them pick every Federal officer? Let's repeal every amendment back to #11 while we're at it.

Two, the Senate WILL vote for Biden.

Thus, we will have Romney and a GOP House looking at Biden and Reed with a Democratic senate majority.

They aren't allowed to vote for Biden if enough electors switch their votes for VP and Obama and Ryan are the top 2 VP vote getters. Have you read the 12th amendment?
 
Electoral college will not go against the popular will of their respective citizenry this time.

Too much downside.
