CNN Panel Stuns Viewers, Shreds Alvin Bragg’s Case against Trump

Weinstein's conviction was reversed because the judge allowed prejudicial testimony that was not part of the crimes charged.

Merchan has done the exact same thing by allowing Pecker to testify.

From the appeals court:

"Under our system of justice, the accused has a right to be held to account only for the crime charged and, thus, allegations of prior bad acts may not be admitted against them for the sole purpose of establishing their propensity for criminality"

Pecker's testimony has nothing to do with the crime charged, which is falsification of business records. There are no business records with AMI. Trump never paid AMI any money for suppressing the McDougal or Doorman stories.

Bragg's "underlying crime" theory is an uncharged crime of "conspiracy to promote or prevent an election", and since that crime is not charged, any evidence of that is inadmissible.

"In either case, if the purpose of the proof is offered to show that the defendant acted in conformity with prior wrongs, acts or a general criminal bent, case law and the New York Rules of Evidence (e.g. 4.21, 6.17, 6.19), (People v Molineux 168 NY 264 [1901], People v Sandoval 34 NY3d 371 [1974]), forbid it. (See also People v Bradley 20 NY3d 128 [2012], People v Morris 21 NY3d 588 [2013]: evidence of uncharged crimes is inadmissible if its only purpose is to show that the defendant is likely to have committed the crime charged or to show bad character)."

 
Oh well, the judge should dismiss those charges any second.
Merchan won't, but an appeals court will.

Besides, what charges? There is no Bill of Particulars as required by NY Law describing the crimes.

There are no Trump crimes. Cohen screwed up the accounting not Trump.

Shreds Alvin Bragg’s Case against Trump

CNN, the network that spent the majority of its airtime attacking President Donald Trump at every turn throughout his presidency, appears to have shifted direction, if the sentiment of their panel on Alvin Bragg‘s Case against Trump is anything to go by.
On Thursday, a panel of CNN analysts agreed that the Manhattan case against Trump is all but doomed due to the lack of evidence.
David Chalian told his colleagues, “I’ve seen precious little evidence presented yet that Trump wasn’t floating above.”

Commentary:
Evidence, Crime? Pfffft. Who needs that? Did this all slip past a grand jury?
We all know about Jury Nullification, but can a jury make up laws? Usually a law carries fines and/or punishment. What guidance will Judge Merchan use?
It appears that the testimony of Hope Hicks and Davidson have torpedoed Alvin Braggs' case.
Meanwhile, down in Fulton County, Fani Willis is sinking deeper into the quicksand.
She was hit with a civil RICO lawsuit by an African-American Republican Mesha Mainor, a member of the Georgia House of Representatives.
Mesha Mainor switched to the Republican party, and ever since has been stalked by a man named Corwin Monson, who seems to have some connection to Fani Willis and her claque.
The story is quite complex, and has the potential to do explosive damage to Fani Willis.

Yeah, that didn't happen.
