Why Isn't This A Death Penalty?

An identity thief divests an elderly widower of his entire, life savings by tapping into his bank accounts. Afterwards, the theif brags and laughs about his act to others. He is arrested and charged with identity theft and grand theft.

How about charging him with a capital offense on the theory that the elderly widower could easily have died of heart attack caused by the shock of learning that his life savings had been stolen?

We can open up a whole new world of criminal liability here - capital offenses for what might have happened as a consequence of the bad guy's actions.

There are people who are a ticking time bomb.

Society needs protection from them.

I understand your frustration - I think we all share it to some degree. But while "stopping crime before it happens" is something nice to think about, the price we as a society would pay for doing so would FAR outweigh any benefit gained by actually trying to do it.

How do you know someone is a ticking time bomb? And even if you did, how could you be sure that incarcerating them would prevent anything?

That isn't a ticking time bomb - that is an exploding time bomb. I don't think you understand the meaning of the phrase, "ticking time bomb." A ticking time bomb is someone who has the potential for explosive action but it is not apparent from the outside. You suggest we jail people for being "ticking time bombs." I repeat my question - how do you know someone is a ticking time bomb until they actually explode?

He didn't take a life, therefore his should not be taken.

Outside of that, locking him up 4 ever could be reasonable! He's dangerous to society and I can't imagine him changing!
Depending on his age, he could possibly change in prison after I'd say around ten years served fully, yet only if he ends up in the right program and the right prison where the turn around rate from bad to good is high on these types of individuals. It could be that he would adapt great to prison life, and would rather stay in prison than be out on the street. There is hope due to his age right now, but he needs the proper rehabilitation during his stay in prison, and if he doesn't get that, then I hope that he doesn't get back out for a long time to come. Do the crime, but then be ready to do the time.

It is bad by what these youths are up to these days in this way, but we as a society ruled by the government now, is creating these monsters all because of, so it is what it is.

a Female art dealer had some guys works on her walls
which conservatives found offensive

they trashed her place

spit on her

and 1 guy sucker punched her!

should that guy be executed for sucker punching the Female art dealer?

(if it helps with your answer she was probably a liberal, probably a feminist)

OK, I just watched the video, and now I think that a charge of attempted murder should be levied also against this perp when found in this case. Note the clothing and grouping of these individuals, in which makes them apear as a gang up to no good ( a pack of dogs) roaming around to cause trouble. If I was a person in this group whom didnot want to go to jail for a long long time, because of his idiot friend who did this, I would turn him in quickly as to show that I was not in agreeance with such an act as it took place that evening. This looks serious to me, and these cats are going to jail I garantee it, because they will be caught no doubt. They may as well give themselves up now, and begin the process of ratting on the one who committed the act of attempted murder on this man, whom was just an innocent person/victim that was just walking along minding his own business.

It matters not how many blows he gave, and so I think where it becomes attempted murder, is when he didnot return and/or stop in order to make sure that he didnot kill the man when his head hit that sidewalk as hard as it did. His friends should be charged as accomplices to the crime, in which should be charged whatever is appropriate for them as well, because none of them returned to check on the man to make sure that he didnot suffer a fatal blow in the situation, but instead walked away laughing.

This looks like something you would see happen on the streets of South Africa or within other parts of Africa and/or within these thrid world countries, in which such selfless acts are committed by people, and where no fear of death and/or the killing of the victim is involved to be in regards for the victim by his perps when attacked. Now here we have it on the streets of America, and it could be getting worse and worse maybe.

No one should ever be executed for sucker punching anyone. The most any prosecutor could ever get out of a vicious, unprovoked, hands-only attack is attempted murder and that would be stretching it horribly, regardless of how bad the attack is.

Attempted murder is not a capital offense. Life, yes. Death penalty - never.
