Why hate crime laws are stupid

What, does "motive" not figure into prosecution anymore? A motive of hate represents a possible danger to others in the same racial/ethnic category as the victim. Plus it is an especially despicable reason for harming someone, more despicable than just about anything else besides lust or cannibalism. Motive is extremely important in determining sentencing. A murderer who murdered by accident or for money is completely different from a murderer who purposefully hunted down a specific type of person for the sole purpose of torturing or murdering them because they were a certain race. Murder is terrible, but there are different degrees to it that make one type of murder different and worse than another type. Hate crime borders on what serial killers do in my book.

they have a category for it. ITs called 1st degree murder.

first-degree murder
A murder that is committed with premeditation or during the course of a serious felony (as kidnapping) or that otherwise (as because of extreme cruelty) requires the most serious punishment under the law

So why then must we equate into a crime "hate" based on racial, sexual, or ethinic preference? Isnt all 1st degree murder a hate crime?

The point is that hate crimes are subjective and do not punish according to the law. they punish according to the opinion of a judge. The law itself defines a persons punishment. If they killed someone whether it was for them being black, for them oweing someone money, for them being a white girl with blonde hair of about 20 years of age, it is clearly defined by our existing laws. Hate crimes try to pile on in order to appease a certain ethinicity and gain public favor for a politician.

I submit to you, if a someone calls a black person a ******, is that a hate crime?

Descriminatory hate is the only motive that changes what the charge is. You can kill somebody over sex, money, business, power, or just for the hell of it and you get charged with the same thing, premeditated murder. If you kill them for race, it's suddenly a federal crime with a stiffer sentence. It's retarded.
