i noticed jen sig's with ....in memory of...or justice for....and a url....being the nosey nell i am ....i checked it...

Virgil Delano Presnell Jr., 43, was sentenced to death in October 1976 in Cobb County. Five months earlier, on May 4, 1976, he kidnapped two school girls . Mr. Presnell lay in wait for the 10- and 8-year-old girls, he confessed. He raped and sodomized the older girl and when 8-year-old Lori Ann Smith tried to run away, he drowned her in a stream. His sentence was overturned in 1992 by a federal appeals court. Mr. Presnell is still awaiting a new sentencing trial.

no need to bore you with all the details....he gets off the orginal death sentence cause some dude at the hotel the jurors were staying at...said "fry him" as the jurors passed by....

he confessed and showed them the body..i am not for the death penalty but if you are gonna have it...you need to enforce it...
 
i changed my mind totally about the death penalty cause of the way its used in the us....i have no moral qualms with killing...some people just flat out need killing...but i do not rejoice in death...

in the us...the death penalty is used to force a confession..ie....confess and we will take the dp off the table...plus in texas you have people being put to death while men have been on death row much longer..and its all due to the laws at the time they were sentenced...let me be clearer...

if you were sentenced 20 years ago..you have unlimited appeals...if you were sentenced 3 years ago...limited appeals...so men who were sentenced long ago are still alive and appealing..while men who were sentenced 3 years ago are dying. that just doesnt seem just to me.
 
We probably view the DP quite similarly. I have no objection to the DP as the ultimate punishment for the ultimate crime. Serial killers, child killers, those who kill LEOs (because they are sworn to protect us and I feel we owe it to them to treat their murderers harshly).... but the way it is applied in the US is hinky in many circumstances.

And, I don't buy into the 'deterent' thing - to me, it is just that some people need killing.

I am pro the DP for certain crimes and certain types on individuals. This guy ticks the box for me.

This person, considering he admitted to his atrocious deeds, would also fall into my very narrow and rare instance of accepting a death penalty decision.

I am generally anti- and I say that anyone who admits guilt should not be killed..

Especially in cases where the DP is the final factor in getting a plea.

If the guy had refused he had done it and was still found guilty, AND showed no remorse, then I could at least understand the sentiment people have for wanting him to die..

Otherwise, I feel that the death penalty is state sanctioned murder, regardless of innocence or guilt. As long as the person is not being killed while in the commission of a felonious and violent crime, as a mode of protecting the immediate livelihood of the individual or individuals being violated, then the government should not OK the outright killing of anyone.

I do understand the sentiment, though- I just wish that more people were more for arming all citizens not in jail, with open carry as a constitutional right by the 2nd amendment, as a means of stopping violent criminals in their tracks, red-handed, so to speak. I have no problem with the person getting killed (better yet, destroyed)- but only DURING the commissioning of the crime itself.
 
This is the kind of criminal that I believe would be best served up some good old fashioned American justice by being hung publically in the town square for everybody to witness what happens to creeps like this. This guy deserves no mercy and for sure not a long life sitting around some prison watching tv and playing in the weight room waiting for father time to kill him. Hang this bastard.

Wow...don't know how I missed this thread, bones. This month was the 36th anniversary of Lori (and her friend's) stalking/kidnapping and rape. And yes, Presnell is still VERY much alive and well here in GA. Doesn't look like he will *ever* be executed, as there is another case going back to the USSC which will determine whether GA's death penalty is legal or not.

Lori's poor parents/family. I don't know how they have survived this hell--almost 4 full decades since she was so cruelly taken from them.

Thanks for making sure this beautiful little girl didn't go unnoticed and uncared about! I'm GLAD you were "nosey as helllll". THAT is why I put the link in my sig line. To make sure she is not forgotten and that justice is had for her....one day.

THANK YOU (as I type through tears for all Lori has missed and for her wonderful family who still love her so much). :)
 
To update:

Presnell was awarded another *penalty phase* trial in 1999 (he does not challege his guilt or innocence, he freely admits what he did. He just doesn't think he should die for it).

I sat through that trial every day and was there when this jury came back with another unanimous "DP" sentence.

Eleven years have passed since then, and Presnell continues to appeal his death penalty on technicalities. Meanwhile another case is going back up to the USSC which will most likely have a bearing on all other DP inmates cases in GA.

I know many here don't agree with the DP, but in this case, having sat mere feet away from Presnell, I can tell you he ozes evil from every pore and it will be a community service when he is finally dispatched to hell.

Truly. If his DP is ever overturned, he will be given a LIFE sentence and released on the spot (as there was NO LWOP in GA in 1976, and they have to follow the sentencing guidelines in place at the time of the original sentence).

If released, Presnell WILL re-offend. There will be more little girls stalked, abducted, raped and killed.

We cannot let that happen. And as long as there is a breath in my body, I will do everything I can to make sure it doesn't.

Presnell shows absolutely NO remorse for his crimes. Lori and her friend were NOT the only girls he stalked, abducted (or attempted to abduct) and rape.

On death row in GA he had KIDDIE PORN sent to him, it was interecepted by the Warden.

Presnell remains a HIGH RISK SEX OFFENDER and all professionals who have evaluated him have concluded that he WILL re-offend if given the chance.

Would you like him to share the same community as YOUR daughter, free to stalk, abduct, molest and kill at will?

Send me your address. I'll see to it that Presnell ends up living right next door to you should his DP ever be overturned.

Lori has missed more than just those events. She missed going to middle school, high school, prom, HS graduation, college, colege gradution, her wedding and the birth of her children, as well as nieces and nephews.

Lori has missed a lot. Her family has missed a lot.

All because Virgil Presnell decided to steal her from her family in May 1974, and snuff out this beautiful little girl's life for his sick pleasures.

Thank you so much for acknowledging Lori's short 8 years on this planet. She is still loved and missed by everyone who knew her.

A long time ago I believed that all humans were redeemable. After nearly seven decades of life, and from meeting some of these people, I realize that some are so twisted that the only thing to do is end their existance. For the safety of all of us.

Once his guilt was established, he should have been hung. I do not believe that it should be a public spectacle, for that would only satisfy people as twisted as he was. Just end the existance of this kind of individual for the safety of all of us.

This thread is seven years old, and it appears that Virgil Delano Presnell is still alive. Does anyone know why he has not been executed? I wanted to post here to let it be known that some of us have not forgotten. He tried to kidnap my younger sister years earlier when we were walking home from school in East Point, Georgia.
