They did not follow the laws of the state regarding parentage (or release thereof) and artificial insemination. This is why legal marriage is so important. Sure. However if the couple had been legally married or the non -birthing woman had legally adopted the child, the case would be without merit.
That should be the law. In cases where an unmarried couple decide to have a child in this manner or adopt, then BOTH should be legal parents. In the case of a same sex couple, both must adopt.
