The idiots didn't learn from the successful states wording of laws.
SB 16 Assault firearms and certain firearm magazines; prohibiting sale, transport, etc., penalties.

The wording of Assault ANYTHING would have been thrown out in the first court appearance. Assault Firearms has no meaning. It's already been ruled that it's too general of a definition and can be used to ban other guns like even the 22LR and the Mini-14 or any other semi auto hunting or sporting rifle. When you read what is in California's law and 7 other states that has been contested in the courts and found to be legal, they use the term "AR-15/AK-47 and their various clones: instead of Assault Rifle. It has to be specific. I wonder if the NRA didn't help write the thing know it wouldn't hold up only for the PR so they could get back to the public's attention.

Only because it was poorly written. I still wonder if the NRA didn't have a hand in writing it. By getting it written so poorly, it makes the NRA look like a savior. Had it been written properly (doing the same thing) it would have been perfectly legal and sustained the court system. As it's written, it won't make it past the first court of appeals.

Several thousand gun owners turned out at the temporary General Assembly Building on Monday, January 13! The hearing room was divided into two areas - the larger area for gun-rights supporters and the other was a smaller area for gun-control supporters.

Gun owners filled up their side of the room quickly, while the gun controllers side was still pretty empty. To make it looked like they had more people and not look so pitiful, a search for gun-controllers in the waiting line outside the meeting room doors was conducted. Countless gun owners in the line were skipped over in the search for more gun-controllers. Whenever a gun controller was found, they were allowed to go into the meeting room, but no more gun owners were allowed in.

Sheriff Scott Jenkins of Culpeper County and Sheriff Richard Vaughn of Grayson County were in the room in support of gun owners. Sheriff Jenkins spoke twice during the hearings.

The meeting was chaired by Democrat Senator John Edwards. The Republicans on the committee pointed out multiple mistakes and even rules that were broken in the running of the committee, but the Democrat-controlled committee ignored the complaints and lurched forward anyhow, rules be damned.

You don't know what you are talking about.....the AR-15 by name, is protected by the 2nd Amendment as are all other rifles like it.......the lower courts have ignored the law....they are in violation of the Constitution. You make up stuff and think you are clever....you aren't.

Here is the summary right off the bill.

Prohibiting sale, transport, etc., of assault firearms and certain firearm magazines; penalties. Expands the definition of "assault firearm" and prohibits any person from importing, selling, transferring, manufacturing, purchasing, possessing, or transporting an assault firearm. A violation is a Class 6 felony. The bill prohibits a dealer from selling, renting, trading, or transferring from his inventory an assault firearm to any person. The bill also prohibits a person from carrying a shotgun with a magazine that will hold more than seven rounds of the longest ammunition for which it is chambered in a public place; under existing law, this prohibition applies only in certain localities. The bill makes it a Class 1 misdemeanor to import, sell, barter, or transfer any firearm magazine designed to hold more than 10 rounds of ammunition.

This is a poorly written bill. It can be rewritten and reintroduced at a later time like it was in 2 states and 3 Cities that I know of. Oregon made the same mistake and hasn't corrected it. I wonder if the NRA isn't helping to write this piece of trash just so they can keep all the gunnutters wound up and can keep the big donations coming in. Or are the people dumber in Virginia than other places.

1. Assault Weapon is a generic term and can be interpreted to mean any semi auto rifle. This will not hold up in any federal court. The ones that make it stick use the phrase "AR-15/AK-47 and the various clones" has already been contested and upheld in more than one Federal Court. Colorado had it written like that for gun regulations (not banning) and it was upheld. California rewrote it that way after it was bounced and it was upheld. So don't get too smug, there gunnutters.

2. Limiting Mags to no more than 10 rounds. The last time that went to court, it was bounced. It was bounced in Colorado in 2013 and was changed to 15 rounds and was upheld. California tried to get the 10 round but ended up changing it to 15 rounds. The Court on that one made a peculiar statement about a "Heller" and 15 rounds. What he meant was 10 is beyond reason but 15 is within reason.

The opening stated is misleading. it's explained later on in the bill. it's talking about Dealers and private sales. And NO mention of confiscating existing ARs ir assault rifles. If you already own one you don't have to turn it in. You just can't sell it, give it way or trade it. This bill is geared more for the Dealers no the private owners. But it's poorly written.

There is no way that a Legislation would EVER put something out like this and expect it to pass. It's an embarrassment. I can hear a bunch of writers in the background snickering in the background that a bunch of uneducated idiots actually accepted and present this. Someone needs to tell those Legislators that they need to fire the bill writers.

That is the good news for you gunnutters. The bad news is, it can be written and presented again. And it will stick.

If states have the right to ban abortion and ban same-sex marriage, then Virginia has the right to ban assault weapons, particularly given the fact that AWBs do not violate the Second Amendment – regardless how unwise, unwarranted, and ineffective those bans might be.
