A federal court of appeals threw out a verdict by a New York jury that found thePalestinian Authority and the Palestine Liberation Organization liable for seven attacks that took place in present-day Israel and Jerusalem between 2000 and 2004.

The attacks had claimed the lives of 33 people and injured many more.

In February 2015, a jury awarded plaintiffs, 11 American families whose relatives were victims of the attacks, $218.5 million of the original $1 bilion dollars sought in damages.

Damages in cases filed under the Anti-Terrorism Act are automatically tripled, making the total the PA would have been required to pay $655.5 million.

But the federal appeals court in New York found on Wednesday that the US federal district court in Manhattan lacked the jurisdiction to try the civil case.

The case had been initiated by the lawfare group Shurat HaDin in 2004.

The Israeli group, which has ties to the Mossad spy agency and operates under the motto “bankrupting terror,” has used the Anti-Terrorism Act to file a number of civil lawsuits against Palestinian institutions or groups working with Palestinians

The Israeli group, which has ties to the Mossad spy agency and operates under the motto “bankrupting terror,” has used the Anti-Terrorism Act to file a number of civil lawsuits against Palestinian institutions or groups working with Palestinians

From the article:

In reversing the verdict on Wednesday in the case, which drew the attention of the Obama administration, the appeals court did not minimize the impact of the six terrorist attacks, which occurred from 2002 to 2004, but it held that the Federal District Court in Manhattan had lacked the jurisdiction to hear the case.

“The terror machine-gun attacks and suicide bombings that triggered this suit and victimized these plaintiffs were unquestionably horrific,” said a three-judge panel of the United States Court of Appeals for the Second Circuit, in Manhattan.

“But the federal courts cannot exercise jurisdiction in a civil case beyond the limits prescribed by the due process clause of the Constitution,” the court added, “no matter how horrendous the underlying attacks or morally compelling the plaintiffs’ claims.”

The court appeared to acknowledge the suit has merit, just that it appears the case against the Arab-Moslem terrorists was apparently brought to the wrong court.

Thanks. Let's hope the plaintiffs will refile.

Because the United States does not recognize Palestine as a state, the PA and the PLO were not eligible for sovereign immunity, a protection Israeli officials have enjoyed to avoid accountability in the US and other venues for war crimes against Palestinians.

As long as the Palestinian Islamo-terrorist scumbags aren't getting US tax dollars any longer, I think vast majority of Americans would be fine with it.

Sorry, clueless. That's not the issue.

Israeli lawyers group Shurat HaDin unmasked as Mossad proxy
The director of a supposedly independent group of Israeli lawyers privately admitted to a US embassy official it acted as a proxy for the Israeli government, a leaked US embassy cable shows.

Nitsana Darshan-Leitner confided in 2007 that her Shurat HaDin group in the past “took direction … on which cases to pursue” and still “receives evidence” from the Mossad and from Israel’s National Security Council.

This is in direct contradiction to public claims, such as on its website which states it is a “fully independent” organization “unaffiliated with any political party or governmental body.”

The group has fought several high-profile “lawfare” cases against Palestine solidarity activists around the world in recent years.

Mossad lead
The leaked cable was unearthed by lobbying transparency outfit SpinWatch in an article earlier this month. It was one of the US embassy cables leaked by former US soldier Chelsea (formerly Bradley) Manning in 2010 and published byWikiLeaks in 2011.

The cable’s author quotes Darshan-Leitner as explaining the government’s rationale for using a proxy rather than going to local courts directly: “The National Security Council (NSC) legal office saw the use of civil courts as a way to do things that they are not authorized to do.”

And the court bankrupts the arab muslims in the process so they have to sell/give the land to the Jews and become what they were 100 years ago. WANDERING BUMS SCRATCHING A LIVING IN THE DIRT

What war crimes are those, where is the evidence of the ICC issueing warrants for arrest on charges of war crimes. The last I heard they were about to start proceedings against the P.A. on charges of war crimes and the P.A. withdrew its action against Israel to stop the terrorists from being arrested.

Even A.I. has declared that hamas is committing war crimes every time it attacks the Jews with illegal weapons

Israel lost, that's your issue

Did they, then who won because the arab muslims will find they have the court costs to pay. And it wasnt Israel that brought the case but individuals affected by the hamas attacks. Watch them now go to another court that can sit in judgement and take the arab muslims to the cleaners.

fanger, et al,

This is a bit ridiculous. But, it is part of an overall Obama White House - Administration, and Political Political Strategy to intentionally shield the PLO and the PA from paying the penalty for their terrorist acts and provide material support to the PLO and PA.

But the federal appeals court in New York found on Wednesday that the US federal district court in Manhattan lacked the jurisdiction to try the civil case.

The Obama Administration and the Democratic Party are betting that no one will draw the connection that they are support the very terrorist they pleged to defend us against. This was a political slight of hand.

Little is it known that the Justice Department and State Department BOTH (at the request of the Democratic President) interceded on behalf of the terrorists to lower the bond; because they argued that they did not want to could cause economic and political harm to the Palestinian Authority and the broader peace process. That was an excuse. NO ONE actually expects the PLO/PA to open reasonable peace process with the Israelis.

The State Department and their 20th Century Diplomatic Dogma, made it known that the US will not enforce monetary penalties on the terrorists, even if the guilt is proven. There is no question as to the perpetrators of these acts. The Democratic Party believes that justice should be sacrificed in fear that these very same terrorist will open an new offensive against the US and US Citizens.

Normally, I don't advocate one way or the other on political matters. But, the Democratic Obama Administration, and the party main, have once again emboldened Radicalized Islamic Extremist and Palestinian Jihadist by being so afraid of them, that they intervened on their behalf. If there was one single reason to avoid support and association with the Democratic Party or any Democratic candidate is that the worked behind the scene to allow Terrorist Organizations to escape justice.

Most Respectfully,

And it really does not matter. The goal of the so called peace process has never been peace. It is just political theatre to keep Palestinians off of Israel's voter rolls until it can complete it colonization of Palestine. Israel's hundred year old colonization continues with or without irrelevant peace talks.
