The U.S. government is trying to force Facebook Inc (FB.O) to break the encryption in its popular Messenger app so law enforcement may listen to a suspect’s voice conversations in a criminal probe, three people briefed on the case said, resurrecting the issue of whether companies can be compelled to alter their products to enable surveillance.

1. Which laws are the DOJ arguing give them the right to force a company to break their encryption to allow the government to listen to conversations? The articles don't specify.

2. Presidents don't create laws, that's for Congress. The executive enforces laws.

3. If Obama and Bush get the blame for laws passed by the legislative branch during their administrations, why shouldn't Trump get the blame for the way the executive branch is trying to enforce those laws during his administration?

We can talk about executive orders, or the seemingly endless bureaucracies in the federal government, and the way they often get around the executive's inability to create law. That doesn't change that the executive can't actually create law.

I think that is a much different thing. The USSC is supposed to determine how the Constitution applies to cases brought before it. They certainly don't always get it right, but even in the case of Roe v Wade it wasn't creating new law, but rather deciding that privacy protections applied to something they previously had not.

It may seem like a small distinction, but I think it is an important one. :dunno:
