A Tucson police officer has filed a federal lawsuit challenging Arizona's new immigration law, claiming the legislation will hinder police investigations in Hispanic-prevalent areas.

The suit, filed Thursday in U.S. District Court in Tucson by Officer Martin H. Escobar, also claims SB 1070 would make police focus more on immigration than helping people in need.

"What are we saying to the undocumented who are victims of crimes, what are we saying to the undocumented who are critical witnesses to crimes?" said Escobar's attorney, Richard Martinez.

The suit also claims the new law, which Gov. Jan Brewer signed on April 23, violates several constitutional rights and also violates federal law because the Tucson Police Department and the city have no authority to perform immigration duties.

Escobar, 45, a 15-year veteran of TPD, noted in the lawsuit his experience patrolling the Hispanic-heavy Operations Division South indicates there's no racially neutral criteria that can be used by officers to determine whether a person is in the country illegally.

"Hey, there's a lot of people lawfully who speak Spanish; there's a lot of people who speak with an accent," Martinez said. "Those tell you that they're Latino or Hispanic or Mexican, but they don't tell you anything about their document status."

Why does it not surprise me? Probably because he is naturalized american citizen = one foot in his country of birth; the other one here.

Ummm....Wasn't the point of the state law to give them jurisdiction to enforce immigration laws?

The Tucson police officer is WRONG and he should quit his job ASAP!!! The Arizona Legislature represents 'We The People' of Arizona and the New Immigration Law is the LAW OF THE LAND!!!! If the Tucson police officer is not capable of enforcing the LAW OF THE LAND, then he is not fit to be a police officer any longer!

This idiotic aspect to his claims is that the Federal Immigration and Employment Laws make it ILLEGAL to be in the USA Illegally!!!!! In fact, the New Arizona Law is built upon the same principles of the Immigration Reform and Control Act of 1986 (Wiki) that is also the LAW OF THE LAND! When the cop pulls you over, then the first words out of his mouth are, "Show me your license and proof of insurance!". However, the Open Border Lobby Idiots around here pretend that Illegal Aliens are not supposed to be asked for 'their' license and proof of insurance, as if citizens of OTHER COUNTRIES can strut around and do as they please.

Try going to Mexico to steal a JOB from a Mexican Citizen without any paperwork and see what happens. Other countries have sense enough to know that allowing foreigners to steal JOBS from the citizenry will destroy the local job market and the tax base and the consumer base. The fact is that the Tucson cop is willing to sacrifice 25 U.S. Citizens EVERY DAY rather than simply do his job that includes cracking down on this ILLEGAL Activity. The Tucson cop would rather continue looking the other way, while America drowns in a sea of Illegal Alien Foreign National Humanity ...

Anyone who oppose the Arizona law is just inciting left wing village idiots to react. Arizona law is a mirror of the Federal Immigration and Nationality Act that has been enforced for since 1929 and the Arizona law is less invasive that the FINA which allow for racial profiling when is is coupled with other suspicion.
Illegal aliens who are protesting is just defeating themselves. And people like Gutierrez is only looking out for his own career. Watch him in 2012.

So, if the Feds rule against the law, then basically the police have no right to arrest anyone for committing a crime. :clap2:
 
The cops should be getting all kinds of money to enforce the new law. I am sure that the right would not do any unfunded mandates.

The real problem here is that so many educated, suppposedly, people have no clue what the bill says! They have jumped on the hysterical bandwagon without a clue as to what this bill entails. Behind all this mob hysteria are the pro-illegal advocates and open border nuts who have taken this to the inth degree. They are doing, will do, and have done more damage than the so called damage the bill would do!!!
