That is how it works in the criminal justice system but not congress. Congressional committees have the power to subpoena. In the House it usually requires a majority vote of the committee. In the Senate the subpoena power of a committee usually rests with the chairmen of the committee. The subpoena is issued by congress not a judge.

Where evidence of criminal activity is required in the criminal justice system, the rules for issuing congressional subpoenas are in the committee rules. The power of Congress to investigate and obtain information is very broad. No proof of wrong doing is required. If the members of the committee suspect something is wrong they subpoena information to further investigate. The power of congressional oversight can be compared to that of your boss at work. He or she does not need any proof that you're not doing your job or obeying the rules to investigate. This is why half of the House investigations turn up nothing of significance. However, about 15% of the investigations turn up material that is very significant.

Trump had a due diligence responsibility to satisfy legal requirements designed to prevent the laundering of money acquired illegally. Why would anyone be surprised he took the money with no questions asked?
