The Japanese attacked Pearl Harbor. What if Roosevelt was on the side of the Japanese?

9/11 Hijackers. What if Bush was on the side of the hijackers?

Russians attack our Democracy. What if Trump was on the side of the Russians?

All three put our country into turmoil.

All three were a direct attack against our country and what it stands for.

Only one of those presidents were on the side of the attackers.

Why isn't that treason?

Article III, Section 3, does not specify that we have to be at war for treason to occur. As a nation, we can and do have enemies, without necessarily being in an active war with them.

As I said, we don't need to be actively at war, to have enemies. War or not, adhering to our enemies, and giving aid and comfort thereto, constitutes treason.

I'd also argue that “war” can be defined more broadly than violent military action. I'd certainly argue that the uncontrolled flooding of foreigners across our southern border in violation of our laws and of our sovereignty constitutes an act of war; and that any Americans who actively take part in allowing or facilitating this are committing treason.
