You do know that espionage is the clandestine infiltration of a government agency and the harvesting of secret information, and subsequently supplying your sponsor with the secrets of the nation you're stealing them from.

Not publishing leaked data that was leaked by officials of the nation you're seeking to damage/embarrass.

I think he should be sanctioned, but not as a foreign spy, because he isn't one.
